AGENDA ITEM: Ordinance No. 90-01-170 Establishing Drainage Requirements for
Properties being Rebuilt/Remodeled.

BACKGROUND: During the last Joint Workshop, the City Commission and the
Community Development Board discuss ed drainage requirements
during planning of new subdivisions and for individual lots. As a result
ofthis discussion, staffinet to review the current and past procedures
for these approvals.
Staff concluded that the subdivision ordinances adequately provide for
subdivision drainage. However, the code did not provide adequate
authority for staff to review and approve proper drainage on individual
lots. As a result, in concert with the City Attorney, we have drafted the
attachedOrdinance.
BUDGET: Not applicable.
RECOMMENDATION: Review and approve the attached Ordinance No. 90-01-170 on first
reading.

AN ORDINANCE OF TIIE CITY OF ATLANTIC BEACH, FLORIDA,
AMENDING Cl'IAPTER 24, ZONING AND SUBDIVISION REGULATIONS,
ARTICLE III, ZONING REGULATIONS, DIVISION 7, SUPPI:ENIENTARY
REGULATIONS, SECTION 24-1b7, SITE PLAN REVIEW, TO PROVIDE
FOR STORNIWATER DRAINAGE REQUII2ENiEN't'S, AND PROVIDING
AN EFFECTIVE DATE.
BE IT ENACTED BY THE CITY CONIMISSION ON BEHALF OF THE PEOPLE
OF THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION 1. Sec. 24-167 of the Code of Ordinances of the City of Atlantic Beach,
Florida, is hereby amended to add a new subsection (g), which shall read as follows:
"(g) Stoiznwater drainage requirements. All lots shall be constructed
and graded in such a manner so that the stormwater drains to the adjacent street, an
existing natural element used to convey stormwater (see Sec. 22-303, Definitions:
stormwater management system), or a city drainage structure. The city shall be
provided with apre-construction topographical survey prior to the issuance of a
building permit and apost-construction topographical survey prior to the issuance of
a certiticate of occupancy. The surveys shall be prepared by a licensed Florida
surveyor, and either or both of the surveys required may be waived by the director
of public works if they are determined to be unnecessary."
SECTION 2. This Ordinance shall t<1ke effect immediately upon its final passage and
adoption.
