Photographs taken the day of the hearing by the Code Enforcement Officer showed partial but incomplete compliance. 6. Respondent testified that the noncompliant areas shown in the photographs were on City property and that he did not have any obligation to maintain City property. CONCLUSIONS OF LAW 7. The City of Atlantic Beach has, via Code § 6-120, adopted the International Property Maintenance Code and incorporated it into its ordinances. 8. Based upon the testimony, ownership, control, and responsibility for maintenance of the areas shown to have continuing violations is disputed and requires additional evidence to determine. ORDER 9. The matter is deferred until the next regularly scheduled code enforcement hearings set for January 9, 2020 at 2:00 p.m. for the taking of additional evidence.
