MAINTENANCE AGREEMENT WITH THE
FLORIDA DEPARTMENT OF TRANSPORTATION (FOOT)

BACKGROUND: We have reviewed the new Maintenance AgreemenYfor
maintaining State Road 10 (Atlantic Boulevazd) from the east end
of the Intracoastal Waterway Bridge to Third Street, and State
Road 101/AlA (Mayport Road) from Atlantic Boulevard to Assisi
Lane. By prior amendment, this Agreement includes maintenance
of the ditch between Saratoga Circle North and Forrestal Circle
South from Mayport Road to Atlantic Boulevazd at Aquatic Drive,
and the ditch from Fleet Landing mm~ingnortlynorthwest along
Mayport Road, terminating at the salt marsh..
Maintenance work involves street sweeping, mowing; litter
removal, edging, tree trimming and pruning.
This Agreement is the same as the previous year and the contract is
for (1) one year beginning July 1, 2001 through June 30, 2002.
The total annual amount which the City of Atlantic Beach receives
from the FOOT for performance of this maintenance is $39.000.00.
RECOMMENDATION: We recommend approval of this Agreement and that the
Commission pass a Resolution torenew the contract, as required
by the. FOOT.

RESOLUTION NO. 01-07
A RESOLUTION OF THE CITY OF ATLANTIC BEACH AUTHORIZING THE
MAYOR TO EXECUTE A MAINTENANCE CONTRACT BETWEEN THE
CITY OF ATLANTIC BEACH AND THE FLORIDA DEPARTMENT OF
TRANSPORTATION, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on June 2,1997, the City executed an agreement with the Florida Department of
Transportation to provide maintenance on certain streets throughout the city; and
WHEREAS, said contract will expire on June 30,2001; and
WHEREAS; the City desires to enter into a new contract with the Florida Department of
Transportation to provide for the continued maurtenance of certain streets throughout the city, for the
period beginning July 1, 2001 and ending June 30, 2002.
NOW THEREFORE, be it resolved by the City Commission ofthe City ofAtlanticBeach as
follows:
SECTION L The Mayor is hereby authorized to execute the Maintenance Contract with the
Florida Department of Transportation on behalf of the City of Atlantic Beach
SECTION 3. This Resolution shall take .effect immediately upon its final passage and
adoption.

Gentlemen:
The Department is agreeable to the renewal of Contract B-C612 with the City of Atlantic
Beach. This is the first renewal of this contract fof the term beginning July 1, 2001 and
ending June 30, 2002.
Please execute the five. (5) enclosed copies of the agreement where indicated. In
addition, a new resolution from the Town Council authorizing the execution of the
renewal agreement will be required. Please return all documents to my attention at the
above address.
Upon receipt of the completed documents, the renewal agreement will be executed on
behalf of the Departrnent and an original will be returned to you.

This Ageement made and entered into this day of , by and between the State of
Florida Deparnnent of Transportation, hereinafter called "Department", and City of Atlantic Beach of 1200 Sand~ner Lane: Atlantic
Beach. Florida 32233-4318 hereinafter called"Contractor".
WITNESSETH:
WHEREAS, the Department and the Contractor heretofore on May 9. 2000 entered into an Ageement whereby the
Department retained the Contractor to perform maintenance of ditch. street swee~e, mowing, litter removah edeine. tree tritnnune
and prumna;
WHEREAS, said Agreement has a renewal option which provides #or a renewal if mutually agreed to by both paities and
subject to the same terms and conditions of the original Agreement;
NOW, THEREFORE, this Ageement witnesseth that for and inconsideration of the mutual benefits to flow each to the
other, the parties agee to a renewal of said original Ageement dated Mav 9. 2000 for a period of one yeaz beginning the
1st day of Julv , 2001 and ending the 30th day of June ; 2002 at an annual cost of $39.000.00 specified herein.
All terms and conditions of said original Ageement shall remain in force and effect for this renewal.
