RESOLUTION NO. O 1-09
A RESOLUTION OF THE CITY OF ATLANTIC BEACH DECLARING A
SPECIAL ASSESSMENT, AS REQUIlZED BY FLORIDA STATUTES,
CHAPTER 170, FOR WATER LINES, STORM WATER IMPROVEMENTS
AND STREET IMPROVEMENTS IN SELVA MARINA UNITS 10, 10-A, 10-
B, 10-C, 11, 12, 12-A, 12-B, AND 12-C REPEAT, AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the Selva Marina Units 10, 10-A, 10-B, 10-C, 11, 12, 12-A, 12-B, and 12-C
replat, located in north Atlantic Beach on the east side of Selva Marina Drive (old Sherry Drive),
were developed between 1978 and 1980; and
WHEREAS, the streets in this subdivision were never dedicated to or accepted by the
City of Atlantic Beach; and
WHEREAS, the ten-year agreement issued by the developer for maintenance of the
streets, expired in 1990 and the streets in this subdivision are in a state of disrepair; and
WHEREAS, the City of Atlantic Beach proposes to construct water, sewer, street, and
drainage improvements; and
WHEREAS, Section 170.03, Florida Statutes requires that the City, by Resolution,
declare a special assessment when defraying the whole or any part of a public improvement by
special assessment, declare the lands upon which the special assessment shall be levied, declare
the total estimated cost of improvements, and declare certain other matters pertaining to such
special assessment.
NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic
Beach as follows:
SECTION 1. NATURE. DESIGNATED STREETS AND LOCATION OF
IMPROVEMENT. The nature of the improvements consists of reconstruction of the following
streets: Sea Oats Circle, Creekside Circle, Oak Circle, Hickory Lane, North Sherry Drive, Dale
Lane, Live Oak Lane north of Saturiba Drive, and 19`h Street between Selva Marina Drive and
Sea Oats Drive; vertical relocation water lines on a portion of 19`h Street, Creekside Circle, Oak
Circle, and Dale Lane to replace the existing water lines where conflicts occur; installation of
new stormwater lines and other storm drainage improvements needed to correct flooding
problems; and street lighting and tree removal as necessary.
SECTION 2. ESTIMATED COSTS; PORTION TO BE PAID BY SPECIAL
ASSESSMENT. One half the cost of installation replacement of water lines, ($65,000:),
stormwater improvements ($110,000.), the full cost of street light installation and tree removal
$8,500, and a portion of street reconstruction ($66,700.) is to be paid by special assessments. The
total cost of the project is estimated to be $604,440. Survey work ($6,000), legal costs ($5,000),
taxes ($14,940), water lines ($65,000), sewer lines ($80,000), stonnwater improvements
($50,000), and street reconstruction ($133,300), is to be paid by the General Improvement Fund
and will not. be included in the special assessment.

SECTION 3. MANNER 1N WHICH ASSESSMENT IS TO BE MADE. Such special
assessment shall be levied equally against all lots and lands which receive benefit, adjoining and
contiguous or bounding and abutting upon such improvements or specially benefited thereby and
further designated by the assessment plat provided as Attachment A to this resolution
SECTION 4. PAYMENT OF SPECIAL ASSESSMENTS. Such special assessments
shall be made in not exceeding ten (10) equal yearly installments with interest at a rate not to
exceed 7% per annum on the unpaid balances from the date of acceptance of the project by the
City, provided that such special assessments may be paid without interest at any time within
thirty (30) days after the project is completed and a Resolution accepting same has been adopted
by the city. The first installment of the special. assessments, together with interest upon the
whole assessment, shall be due and payable on the first day of November after the date of
acceptance of the project by the City, and like payment, together with interest upon the unpaid
balance of the special assessment, shall be due and payable on November ls` in each and every
year thereafter until paid in full; provided that unpaid balances of assessments maybe paid at any
time by payment of the principal and interest due thereon to the date such payment is made. The
special assessments will be based on the actual cost of the project.
SECTION 5. PUBLICATION. The City Clerk of the City is hereby directed to cause
this Resolution to be published once a week for a period of two (2) weeks in a newspaper of
general circulation published in Duval County, Florida.
SECTION 6. This Resolution shall take effect immediately upon its final passage and
adoption.
