AGENDA ITEM: TTA Mayport Road Retention Pond Tree Mitigation

BACKROUND:
The Atlantic Beach Tree Conservation.Board has approved a proposed
contract with he JTA_to .allow removal of 334 inches of trees at the site
north of 230.1 Mayport Road. The mitigation will require 167 inches of trees
to be placed at off site. locations. The contract allows TTA to install trees on
Mayport Rd. or in other areas..designated by the City of Atlantic Beach
within threeyears of the.date of the_contract. If the TTA does not meet the
three year deadline they will pay a sum of $13,778 into the tree fund.

INTERAGENCY AGREEMENT BETWEEN THE
JACKSONVILLE TRANSPORTATION AUTHORITY
AND THE CITY OF ATLANTIC BEACH FOR
TREE MITIGATION
THIS AGREEMENT made and entered into this day of ,
2001, by and between the JACKSONVILLE TRANSPORTATION AUTHORITY ("JTA")
and the CITY OF ATLANTIC BEACH ("City").
WITNESSETH:
WHEREAS, the JTA is constructing the Wonderwood Connector between Girvin Road
and State Road AlA as shown on the construction plans prepazed for the JTA' and
WHEREAS, the JTA intends to construct a compensatory drainage pond to treat storm
water runoff from Mayport Road as shown on in Exhibit "A", so as to avoid more costly
treatment of storm water runoff from the Wonderwood Connector; and
WHEREAS, the JTA will be required to comply with the City's tree protection
ordinance before constructing the said pond in order lawfully to remove the bees as identified
on Exhibit "B"; and
WHEREAS,. the City intends to seek approval and funding from the Florida
Department of Transportation to remove certain portions of the two-way left-turn lane on
Mayport Road and replace it with raised landscaped median islands; and
WHEREAS, the JTA is willing to assist the City by providing the required mitigation
for the trees to be removed in the area of the said pond by purchasing and installing trees in the
proposed median islands on Mayport Road; and
WHEREAS, the parties hereto have reached an agreement on the removal of trees and
the way in which tree mitigation will be provided and wish to set forth such understanding in
writing.
NOW, THEREFORE, in consideration of the mutual covenants contained herein,, the
parties agree as follows:
1. The JTA shall allocate the sum of $13,777.50 specifically for the purpose of
installing trees in the median azeas of Mayport Road to be built by others.

2. In the event that after the passage of three yeazs of the date of this Agreement,
there are no median azeas of Mayport Road suitable for landscaping, then the
JTA will install trees to the value identified above on other public rights-of--way
in the City of Atlantic Beach in azeas to be agreed upon at a later date.
3. In the event that no other public rights-of--way aze selected by the City for this
tree mitigation contract, the JTA will pay into the tree fund at a rate of $82.50
an inch for the required 38 inches of oak and 129 inches of hardwood.
4. The City will hereby authorize JTA to remove trees as identified in Exhibit "B"
from the pond area depicted in Exhibit " A" .
