Please be advised, the City of Atlantic Beach Code of Ordinances includes rules and regulations governing
construction activities and also maintenance standards for property within the City. These standards are set forth
in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the
City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section 6-16.
A code enforcement inspection at 2321 MAYPORT RD was conducted on 11/13/2019. The City of Atlantic
Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of
Ordinances:
VIOLATION CODE: Sec. 12-1.Nuisances(a) It shall be unlawful for any person or business,to do, perforin,
have,allow, suffer or permit any act, occurrence or condition within the city which constitutes a dangerous,
unsafe, dilapidated or unsanitary condition,which may be injurious to the health and well being of the
community.
NATURE OF VIOLATION: Excess trash and debris has accumulated around the dumpster and is being blown
around the surrounding area.
This letter requests that the noted violation(s) be corrected by removing all of the boxes and other trash
from the parking lot and around the dumpster immediately upon receipt of this notice. In accordance with
Section 16-3 of the City of Atlantic Beach code of ordinance, the Director of Public Works may direct that your
dumpster size or service frequency be increased if the dumpster is routinely overfilled.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in
this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty
dollars ($250.00) per day. Upon completion of the action required, it is your responsibility to contact me and
arrange for an inspection to verify compliance. Please contact Atlantic Beach Code Enforcement at (904) 247-
5855 if you have any questions or need additional information.

Special Magistrate on January 9, 2020 at 2:00 pm at Atlantic Beach City Hall, Commission Chamber,
800 Seminole Road, to answer and be heard on the following alleged violations on the property known
as 2321 MAYPORT RD, RE#169398 0410, 08-2S-29E 1.859, PT GOVT LOT 7 RECD, O/R 17101-
1436. The City of Atlantic Beach adopted the International Property Maintenance Code and the Florida
Building Code as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section
6-16.

Sec. 12-1. Nuisances (a) It shall be unlawful for any person or business, to do, perform, have, allow,
suffer or permit any act, occurrence or condition within the city which constitutes a dangerous, unsafe,
dilapidated or unsanitary condition, which may be injurious to the health and well being of the
community.
STATEMENT OF CODE ENFORCEMENT OFFICER: On 11/26/2019 the undersigned Code
Enforcement Officer conducted an inspection of the premises located at 2321 MAYPORT RD. During
the inspection, the undersigned Code Enforcement Officer observed that the property was in violation of
the section listed above in the City of Atlantic Beach Code of Ordinances. The nature of the violation
included: Excess trash and debris has accumulated around the dumpster and is being blown around the
surrounding area..
If the violation is corrected and then recurs or if the violation was not corrected by the time specified for
correction by the Code Enforcement Officer in the Notice of Violation that you received, the case may
be presented to the Code Enforcement Special Magistrate even if the violation has been corrected prior
to the hearing.

ORDER ON CASE No. 19-242
THIS CAUSE came for public hearing before the Code Enforcement Special Magistrate on January 9,
2020, and the Special Magistrate having heard testimony under oath, received evidence, and heard
arguments respective to all appropriate matters, issues findings of fact, conclusions of law, and orders
as follows:
FINDINGS OF FACT
1. Respondents own the property located at 2321 Mayport Road, Atlantic Beach, Florida.
2. Notice of the hearing was sent by Certified Mail.
3. Attorney Maxwell Winick appeared for Respondents at the hearing.
4. On November 13, 2019 Respondent was sent a code enforcement warning letter about an
excessive accumulation of cardboard boxes around one of Respondent's dumpsters.
5. The excessive accumulation of boxes allowed boxes and other materials to be blown off
Respondent's property and onto adjacent properties, in addition to creating an eyesore.
6. The warning letter was sent as a result of citizen complaints.
7. As of December 5, 2019, Respondent had not corrected the violations.
8. Respondent sought a re-inspection to determine compliance on December 12, 2019, and the
re-inspection established that Respondent was in compliance.
CONCLUSIONS OF LAW
9. The amount of time it took Respondent to correct the violation justifies the imposition of a
one-time $250 fine to act as a deterrent to future violations.
ORDER
10. It is ORDERED that a fine of$250 shall be imposed, and failure to pay it will result in a lien
being placed against the property at 2321 MAYPORT ROAD, PARCEL NO. 169398 0410,
LEGAL DESCRIPTION 08-2S-29E 1.859 PT GOVT LOT 7 RECD O/R 17101-1436 for
the total assessment plus costs incurred for the filing of the lien. All lien amounts are to be
made payable at an interest rate of 10% per annum from date of certification until paid.
DONE AND ORDERED THIS 31 DAY OF JANUARY, 2020.
