Dear Property Owner:
Please be advised, the City of Atlantic Beach Code of Ordinances includes rules and regulations governing
construction activities and also maintenance standards for property within the City. These standards are set forth
in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the
City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16.
A code enforcement inspection at 516 AQUATIC DR was conducted on 11/15/2019. The City of Atlantic Beach
Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances:
NATURE OF VIOLATION: A white vinyl fence has been installed on your property without first obtaining a
permit from the City of Atlantic Beach. This unapproved fence encroaches on the 5 foot easement along the side
and rear of your property.
VIOLATION CODE: Sec.24-157.Fences,walls and similar structures. (a) Permit required. Issuance of a
permit is required for any new or replacement fence or wall and walls shall comply with the following provisions.
Nonconforming fences shall not be replaced with nonconforming fences. The term fence and wall may be used
interchangeably within this chapter,and shall mean as specifically defined within section 24-17. Fences must be
constructed out of materials that are customarily used for fences.
This letter requests that the noted violation(s) be corrected by submitting a fence permit application to the
City of Atlantic Beach showing the fence in the correct location within ten (10) days of the receipt of this
notice.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in
this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty
dollars ($250.00) per day. Upon completion of the action required, it is your responsibility to contact me and
arrange for an inspection to verify compliance. Please contact Atlantic Beach Code Enforcement at (904) 247-

8. A. An easement upon each Lot (except for thatortion
thereof on which a Living Unit shall be located and maintained
constituting a part of a Master Parcel is reserved for the benefit of the
other Lots constituting a part of such Master Parcel for the location and
maintenance of utility facilities, manholes, pipes and conduits for
electrical , water, sewerage, telephone and cable television, and each
Owner of a Lot constituting part of a Master Parcel for whose benefit
such Easement is imposed and such Owner' s agents, contractors and
employees shall have an easement of access on, over and across that
portion of each other Lot subject to such Easement for the purpose of
maintaining, repairing and replacing any such utility facilities, pipes
and conduits.
B. Each Owner of a Lot shall be responsible to repair,
maintain and replace that portion of the utility facilities , pipes and
conduits referenced in paragraph 8A which serve solely the Living Unit
situated upon such Lot of such Owner.
C. Except as provided in paragraph 8B, and except where
the responsibility is properly borne by utility companies, each Owner of
a Lot constituting a part of a Master Parcel shall be jointly responsible
with all Owners of the Lots on- such Master Parcel for and will repair,
maintain and replace, when requisite, the utility facilities, pipes and
conduits for electrical , water, sewerage, telephone and cable television
located and maintained on such Master Parcel outside of any Living Units
which serve solely the Lots constituting a part of each Master Parcel and
accordingly, if such utility facilities, pipes and conduits require
repair, maintenance or replacement, then each Owner of a Lot constituting
a part of such Master Parcel shall be responsible to pay on account of
any cost of such repair, maintenance or replacement an amount determined
by multiplying such cost by a fraction in which the numerator is 1 and
the denominator shall be the number of. Lots in such Master Parcel.
D. The rights of an Owner of a Lot to contributions from
any other Owners as provided in paragraph 8C shall be appurtenant to the
land and shall pass to such Owner's successors in title.
E. In the event of any dispute arising under the
provisions of this Section 8, the same shall be determined by a single
arbitrator appointed by and acting in accordance with the rules then
obtaining of the American Arbitration Association.
L 9. A non-exclusive easement for ingress and egress is reserved
for the benefit of each owner in a Master Parcel and such Owner's agents,
contractors and employees upon that portion of all other Lots in such
Master Parcel which lies ._wi-th--in five feet of the side and rear des of
such Ma x J ar-c.e1.. Such easement is limited to pedestrian traffic as
well as lawn maintenance and similar equipment. No fence shall be
located within such easement. -
�� Except as herein otherwise provided, each Living Unit shall
be main : ned by the Owner thereof in reasonable condition and so as to
present a neat and attractive condition and all exterior colors and
materials, including the exterior walls, trim, doors and roof, shall be
retained as close to the original as reasonably possible. Further,
(i) no aluminum foil or similar reflective material of any type will be
placed or permitted to remain at or on the windows of any Living Unit if
the same is visible from the exterior and (ii) no windows will be tinted ,
colored or otherwise treated or have anything applied thereto which would
change the uniform exterior appearance of all the windows on the Master
Parcel.
