Please be advised, Atlantic Beach Code Enforcement has found your property referenced above
to be in violation of the City of Atlantic Beach, Code of Ordinances, to wit:
VIOLATION
Chapter 24 - Fences, walls and similar structures.
Sec. 24-157 Fences, walls and similar structures.
(C) Height and location.
(1) For corner lots located on right of ways that are fifty
(50') or less in width, no fence, wall or landscaping
exceeding four(4) feet in height, shall be allowed within
ten (10) feet of any lot line which abuts the street. (fence installed
on corner side yard exceeds maximum height limit of four (4) feet not in
accordance with approved site plan fence permit#13-2165)
This letter requests that the noted violations be corrected by removal of the six (6) foot tall
fence installed on the property line on the corner or relocating the fence ten (10) feet off
the property line or by changing the height of the fence at the current location by reducing
the height to four(4) feet within ten (10) days of the receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00) per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.

(1) This property(698 Beach Avenue) consists of two parcels that were joined together in an "L" configuration. The
existing house was located on the Beach Avenue parcel, and was assigned a Beach Avenue address (changed
from 7th Street) by the Building Dept. This is how the "front" of this house came to be on Beach Avenue. The
portion nearest Ocean Blvd, where the pool and outdoor living space is located, is the rear of the lot. Section
24-84(c) applies to platted through lots, for instance those that are vacant, or those that have been demo'd and
completely redeveloped, not existing developed lots, already having a different orientation and/or address.
(2) Ocean Blvd is a 60' wide right-of-way, according to Plat 9-35 (Daniel & Hackett Replat of Block 16,Atlantic Beach
S/D "A"), and therefore Section 24-157(c)(2), as follows, applies:
• For corner lots located on rights-of-way that are wider than fifty(50)feet,fences may be
constructed within the side yard adjacent to the street at a maximum height of six(6)feet, provided
that the fence is on the private property and shall not be located closer than fifteen (15)feet from
the edge of the street pavement or closer that five (5)feet to any sidewalk or bike path.
The above information was provided to the applicant, and copies of the development orders issued as a result of
the variance request for the other portions of the fence subject to variance were provided to the applicant.
However, it is my understanding that the applicant commenced construction of the fence prior to pulling a fence
permit,and Mike Jones placed a stop-work order on the job. Whenever the applicant submitted the building
permit application, it was again emphasized that the Ocean Blvd side fence would have to comply with the
provisions of 24-157 (c)(2), stated above. According to AS400, Planning/Zoning, Public Works, and Public
Utilities have all signed off on the fence permit, but Public Safety has not, and there is not review step listed for
Building to sign off. The permit number is 13-00002604.

(3) Regarding 298 Pine Street (FENCE 13-00002165)—This application was submitted as a 6' "replacement"fence
along the property line. I searched Laserfiche and I could find nothing in the file that showed there had ever
been a 6' high fence in that location/no previously issued variance. I originally denied the application based
upon Section 24-157(c)(1),which states:

After my denial of the permit,the property owner came in and met with me and I told her that the fence could

Mike,
I was not present at the Feb CDB meeting, but was not overly concerned with the result of the respective
variance for this property until I saw the fence being constructed.
Note also that the owners also explicitly said in their variance application that they would build a shadowbox
privacy fence,but did not.
At least these people applied for a variance. I'm impressed that the people on the corner lot at 298 Pine street
managed to violate the fence rules (sometime earlier this year)without the city noticing.
