These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section 6-16. A code enforcement inspection at 1187 MAIN ST was conducted on 12/2/2019. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the following City of Atlantic Beach Code of Ordinances: 1. VIOLATION CODE: Florida Building Code Section 105 Permit 105.1 Required. Any owner or authorized agent who intends to construct, enlarge,alter,repair,move,demolish,or change the occupancy of a building or structure,or to erect, install, enlarge, alter,repair,remove,convert or replace any required impact resistant coverings,electrical, gas, mechanical or plumbing system,the installation of which is regulated by this code, or to cause any such work to be done,shall first make application to the Building Official and obtain the required permit. NATURE OF VIOLATION: Multiple accessory structures have been constructed on the property without obtaining a City of Atlantic Beach building permit. Structures include a metal roofed carport, at least two metal sheds and a tarp roofed carport. 2. VIOLATION CODE: Chapter 24. Land Development Regulations. Sec. 24-151 (d). Detached private garages,carports, guest houses or guest quarters,shall not exceed six hundred(600)square feet of lot area and fifteen(15)feet in height. Only one(1)detached private garage,carport,guest house or guest quarters shall be allowed on any single residential lot and shall be a minimum distance of five(5)feet from rear and side lot lines. Such detached structures exceeding six hundred(600) square feet of lot area shall comply with applicable setbacks as established for the principal building. NATURE OF VIOLATION: Two carport structures are present on the property. A metal roof carport structure behind the home and a blue tarp covered carport in the southeast corner of the property. The metal roof structure has been constructed in the rear yard without an approved building permit. According to aerial photographs, the structure may exceed 600 square feet and would be subject to the same building setbacks as the principal home. The blue tarped structure in the southeast corner of the property appears to be closer than 5 feet from the side and rear yard property lines. ACTION TO CORRECT: Please remove one carport and submit a permit application and request an inspection for the other to determine of the structure meets current building codes. If the larger metal roof structure in the rear yard exceeds 600 square feet, it would not be permitted in its current location. If it is less than 600 square feet, it would need to be at least 5 feet from the property line. The remaining structure must pass inspection by the Building Inspector to be considered in compliance. 3. VIOLATION CODE: Chapter 24. Land Development Regulations. Sec. 24-151 (L). Storage and tool sheds,not to exceed one hundred fifty(150)square feet and twelve(12)feet in height. Only one(1)detached storage or tool shed shall be allowed on any single residential lot, and such structures shall be a minimum distance of five(5)feet from the rear and side lot lines. NATURE OF VIOLATION: At least two metal storage sheds have been installed on the property. ACTION TO CORRECT: Obtain a valid permit for 1 storage shed and request an inspection from the City of Atlantic Beach building department. Remaining unpermitted shed must be removed from the property. 4. VIOLATION CODE: Sec. 24-173.Neighborhood preservation and property maintenance standards. (b) Appropriate maintenance and upkeep. All areas of a lot and structures that are visible from the street or a neighboring property shall be maintained in an acceptable manner,which shall be defined by the following characteristics: 1. Lots are maintained free from litter,trash, debris,discarded belongings, automotive parts, old tires,construction materials,and broken and abandoned items. NATURE OF VIOLATION: Discarded belongs and materials appear to be accumulating in the back yard. Please clear the yard of these items. This letter requests that the noted violation(s) be corrected within thirty (30) days of the receipt of this notice. Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty dollars ($250.00) per day.
