SU$MITTED BY: Sonya Doerr, AICP, Community Development Director DATE: November 15, 2001 BACKGROUND: This request seeks approval of aUse-by-Exception to allow for a cabinet and furniture repair business to be relocated to a new 6,850 square foot building. This section of Mayport .Road consists of various relatively high intensity commercial uses, and development of this vacant lot will eliminate its frequent use for criminal and nuisance activities. It is Staff s opinion that the proposed use is consistent and compatible with surrounding uses, and further, that development of this lot will create an improvement to, this portion of the Mayport Road Corridor. Development of this lot will be required to fully comply with the City's landscape regulations. Staff finds that the request .complies with Section 24-63 and recommends approval of the requested Use-by-Exception. (This item was heard by the Community Development Board of the October 17th meeting, and was .continued until the November 20th meeting of the CD Board. Staff will provide the CD Board's recommendation regarding this application at the Commission meeting.) RECOMMENDATION: Motion. to approve UBE-2001-02, aUse-by-Exception to allow a cabinefand furniture repair shop to be located on a portion of GovernmentZots 2 and 3 within Section 17, Township 2S and Range 29E, which is an un-numbered lot located on the east side of Mayport Road south of Dora Street within the 1800 block.. This section of Mayport Road consists of various relativelyhigh intensity commercial uses, and development of this vacant lot will eliminate its frequentuse for criminal and nuisance activities. The applicant has advised staff that the business will receive no more than three deliveries a day and that vehicular traffic produced by the business is very limited. It is Staff's opinion that the proposed use is consistent and compatible with surrounding uses, and further, that development of this lot will create an improvement to this portion of the Mayport Road Corridor. Development of this lot will be required to fully comply with the City's landscape regulations. Staff fords that the request complies with Section 24-63 and recommends approval of the requested Use-by-Exception. SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to recommend approval to the City Commission of the requested Use-by-Exception to allow for a cabinet,shop and furniture repair-shop on property located on Mayport Road, and more particularly described as a portion of Government Lots 2 and 3 within Section 17, Township 2S and Range 29E, provided: (Provide findings of fact similar to the following, and attach other conditions as may be appropriate.) 1. Approval of this Use-by-Exception is incompliance with therequirements of Section 24-63, Zoning and Subdivision Regulations for the City of Atlantic Beach. 2. The request is not contrary to public interest and is not detrimental to the health, safety and welfare of general public. 3. The proposed use is compatible with adjacent properties and other properties within the surrounding azea. 4.
