Thompson Director of Public Safety Background: Please see the attachment from the Jacksonville Port Authority. The Jacksonville Port Authority signed an agreement ~~~ith the City of Atlantic Beach stating that they would provide $30,000 of funding for the replacement of the culvert for Dutton Island, as a part of mitigation for dredging project on St. Johns Creek. However, after the agreement was signed, the Port Authority ran into problems with the dredging project. Since the $30,000 was predicated on the dredging project, the Port Authority is not going to provide the money for the culvert. The City of Atlantic Beach has completed work on the culvert and paid for the work. The 1999-2000 budget anticipated a $30,000 revenue to reimburse the City of Atlantic Beach for this expense. As a result, the $30,000 will need to be adjusted in the future to recognize this change. The Dutton Island project is continuing with Landers-Atkins Planners, Inc. working on the construction design. The Forestry Service has completed the controlled burn on the island. The budget for the development of Dutton Island includes $111,618 from the Atlantic Beach budget for 1999-2000, $25,000 reimbursement from FIND for design work, and $40,000 from the Jacksonville Port Authority for the Fresh Water Marsh creation. Additionally, we are pursuing FIND funding for construction costs for the park. At this time, we do not know what the construction costs will be, and we have no -- - guaranty from FIND on a grant for construction. However, we remain optimistic that we will be able to fund the majority of the project within the existing budget, and we will keep you advised of any developments related to this project. On December 14, 1999, the Jacksonville Port Authority took this issue before Governor Bush and his Cabinet, sitting as the Board of Trustees of the Internal Improvement Trust Fund. We were unsuccessful in persuading the Governor and his Cabinet to refute the objections of the United States Department of the Interior (The National Park Service) and issue the Submerged Land Lease, which was necessary in order to proceed with the project. This presentation before the Governor was our last effort; and upon the advice of our legal counsel, we are terminating all activity on this project. Therefore, as our Agreement was predicated upon obtaining a permit to proceed with the- project, no contribution will be possible and the Agreement is considered null and void.
