BACKGROUND: The Commission heard this item at their regular meeting on May 22, 2017 where they moved it forward to a Public Hearing on June 12, 2107.
At that meeting Commissioners asked about the type of alcohol license that would be sought from the state and how it might differ from more common licenses. The applicant is seeking
a Bottle Club license from the state. The state provides the following for the terms of a bottle club license; “Bottle Club means a commercial establishment operated for a profit wherein
patrons consume alcoholic beverages which are brought onto the premises and not sold or supplied to the patrons by the establishment. Establishment must be located in a building or
other enclosed permanent structure. Licensee may not hold any other alcoholic beverage license for the premises while licensed as a bottle club. Purchases of alcoholic beverages for
resale are not permitted.” The big difference is that no alcohol is sold on site. All alcohol is brought by the patrons.
This is a rare license with only 43 in the state compared to the 12,774 2COP licenses that allow on-premises sale and consumption of beer and wine. There is nothing else unique to this
license type and all other regulations are the same as other license types. The applicant will limit events to 21 and up when alcohol is present to avoid any issues.
Ultimately, the exact type of license sought is not considered under the code. Approval of this use-by-exception will allow on-premises consumption of all alcoholic beverages at this
location, regardless of if it is sold on site or not, unless a condition is enacted to specify the type of license allowed.
