703 Atlantic Boulevard 17-UBEX-497 Staff Report CITY OF ATLANTIC BEACH  COMMUNITY DEVELOPMENT BOARD  STAFF REPORT    AGENDA ITEM 4.A CASE NO 17-UBEX-497 Request for a use-by-exception as permitted by Section 24-111(c)(3), to allow on-premises consumption of alcoholic beverages in accordance with Chapter 3 of the code 703 Atlantic Boulevard Unit 707. LOCATION 703 ATLANTIC BOULEVARD, UNIT 707 APPLICANT ATLANTIC BEACH PAINT PARTY DATE MAY 9, 2017 STAFF DEREK W. REEVES, PLANNER STAFF COMMENTS The applicant is Atlantic Beach Paint Party, owned by Amy Carson. The business offers painting classes where individuals and groups are provided supplies to paint a featured picture. Attendees are encouraged to bring food and drinks, including wine, to enjoy during the 2-3 hour session. The location is within an existing shopping center at 703 Atlantic Boulevard, Unit 707 in the Commercial General (CG) zoning district. A use by-exception is required by Section 24-111(c)(3) for onsite consumption of alcohol. The location is within an existing shopping center so there will be no changes to the exterior of the building or access to the property. Trash is kept in existing receptacles in the back of the shopping center. Hours of operation vary, but classes end at 9 PM Sunday through Thursday and 10 PM on Friday and Saturday. Other businesses in the shopping center include a restaurant, laundry mat, appliance repair and insurance office with a barber shop located in the adjoining unit. Half of these businesses have daytime hours while the other have are more evening based creating a good parking situation. The property to the west is a gas station in CG and the property to the east across Seminole Road is another shopping center in CG. To the north is a two family and single family neighborhood. Page 2 of 2  SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to recommend approval to the City Commission of a requested Use-by-Exception (File No. 17-UBEX-497) to allow on-premises consumption of alcoholic beverages in accordance with Chapter 3 of the code within the Commercial General (CG) Zoning District and located at 703 Atlantic Boulevard, Unit 707 provided: 1. Approval of this Use-by-Exception is consistent with the intent of the Comprehensive Plan. 2. Approval of this Use-by-Exception is in compliance with the requirements of Section 24-63, Zoning, Subdivision and Land Development Regulations. 3. The requested use is consistent with Section 24-111(c) in that the proposed use is found to be consistent with the uses permitted in the CG zoning district with respect to intensity of use, traffic impacts and compatibility with existing industrial uses, commercial uses and any nearby residential uses. SUGGESTED ACTION TO RECOMMEND DENIAL The Community Development Board may consider a motion to recommend denial to the City Commission of a requested Use-by-(File No. 17-UBEX-497) to allow on-premises consumption of alcoholic beverages in accordance with Chapter 3 of the code within the Commercial General (CG) Zoning District and located at 703 Atlantic Boulevard, Unit 707provided: 1. Approval of this Use-by-Exception is not consistent with the intent of the Comprehensive Plan. 2. Approval of this Use-by-Exception is not in compliance with the requirements of Section 24-63, Zoning, Subdivision and Land Development Regulations. 3.
