To: Community Development Board From: Community Development Department Date: January 17, 2006 Subject: UBE-2006-01 Applicant: DRMP, Inc. for Dunkin’ Brands, Inc. 3611-14 St. Johns Bluff Road, South Jacksonville, Florida 32224 Request: Request for a Use-by-Exception to allow for drive-through service in association with a new Dunkin’ Donuts restaurant within the Commercial General (CG) Zoning District to be located at the northwest corner of Atlantic Boulevard and Sailfish Drive. Location: 719 Atlantic Boulevard Existing Zoning: Commercial General (CG) Future Land Use: Commercial Surrounding Land Use: Various commercial uses. STAFF COMMENTS The Commercial General regulations (as follow) require approval of a Use-by-Exception for restaurants that have drive-through service. This site is of sufficient size and has adequate parking, access and internal circulation, as shown on the attached site plan, to accommodate the proposed drive-through lane. Staff recommends approval of this request. (c) Uses-by-Exception. Within the CG Zoning Districts, the following Uses may be approved as a Use-by-Exception. (4) Restaurants with drive-through service where the site contains lanes dedicated solely to drive-through business. (This shall not be construed to include restaurants with carry-out service, which are a Permitted Use.) SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to recommend approval to the City Commission of a requested Use-by-Exception to allow for a drive-through lane in association with a restaurant to be constructed at 719 Atlantic Boulevard within the Commercial General (CG) Zoning District, provided: (Provide findings of fact similar to the following.) Approval of this Use-by-Exception complies with the requirements of Section 24-63 of the Land Development Regulations.
