725 Atlantic Boulevard (3&15) 16-UBEX-101 Staff Report CCCITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: 16-UBEX-101 Public Hearing Request for a use-by-exception as permitted by Section 24-111(c)(3 and 5), to allow on-premises consumption of alcoholic beverages in accordance with Chapter 3 of the code and to allow limited wholesale operations at 725 Atlantic Boulevard Units 3 and 15. SUBMITTED BY: Derek W. Reeves, Planner DATE: June 24, 2016 STRATEGIC PLAN LINK: None BACKGROUND: The applicant is Charles Horn with the Atlantic Beach Brewing Company. The applicant is requesting to open a micro brewery with a tap room at 725 Atlantic Boulevard, Units 3 (a storefront) and 15 (a rear space). Beer will be brewed in the warehouse-like space of Unit 15 and sold to customers in the tap room located in Unit 3. Beer will also be sold by the keg to a wholesale distributer out of Unit 15. A portion of Unit 15 will be set up as flex space with a separate bar for indoor games or event hosting. A use-by-exception is required by Section 24-111(c)(3 and 5) to allow on-premises consumption of alcoholic beverages in accordance is Chapter 3 of the code and to allow limited wholesale operations. The tap room is located within an existing commercial strip center in the Commercial General zoning district. Within the strip center there are restaurants that also sell alcohol as well as retail and service establishments. The rear of the building is comprised of several warehouse-like spaces with uses like laundry facilities and artists. There are commercial and multifamily residential to the east of the shopping center and single family residential to the north. Parking is provided by the shopping center in both the front and rear and will be unchanged. Construction on the property would include an interior build out of both units, the addition of some windows into the brewing area, the addition of a new piece of mechanical equipment by the rear loading door and new signage. The interior build out will attempt to limit noise by installing sound dampening measures between the tap room and adjoining nail salon At the June 21st Community Development Board meeting, approval was recommended to the City Commission by a vote of 5-2 with conditions that; 1.) The hours of operation be limited to 11 PM Sunday through Thursday and midnight Friday and Saturday; 2.) Customers be prohibited from standing in the hallway connecting the two units; 3.) That all employees must park in the rear parking lot; and 4.) All spent grains and other similar waste from the brewing process be stored inside the building. BUDGET: None. RECOMMENDATION: (From the CDB) To approve the Use-By-Exception 16-UBEX-101 with conditions that; 1.) The hours of operation be limited to 11 PM Sunday through Thursday and midnight Friday and Saturday; 2.) Customers be prohibited from standing in the hallway connecting the two units; 3.) That all employees must park in the rear parking lot; and 4.) All spent grains and other similar waste from the brewing process be stored inside the building.
