751 Atlantic Boulevard UBE-2006-03 Staff Condition Summary Considered by the Community Development Board at June 20th meeting. Unanimous recommendation of approval of the Use-by-Exception as requested. AT the CD Board meeting, the Applicant was asked to address sound and impacts to adjacent residential; security and parking. The North Beach Center parking lot contains 338 spaces. (does not include outparcel and parking available on adjacent lots. COAB parking regulations do not have an off-street parking standard for this type of use, but we have used the one space for 4-seat standard since that is the most similar standard in our Code. We have also used the Applicant’s estimate of a 1000 person capacity to determine an parking requirement of 250 spaces. (Actual capacity would be determined by the Fire Marshall at the time of business licensing. Using the 338-space parking space count, this would leave 88 spaces available for other business during hours the Freebird Café’ would be operating. Most all of the other businesses are closed by 6-8pm. Staff recommends a condition that all service, loading and bus parking after the hour of 5:00pm be conducted from the front of the building and that all patron entrances and exits (other than emergency / fire exits) for use before and after shows be restricted to the front of the building.
