Thank you for meeting with me yesterday at 11:00AM. I talked with Bill
Gulliford this morning, and he agrees with this effort. He also has
talked his neighbor, Mr. Skinner, who also supports the Application, and
Bill indicated that Mr. Weiss will also be in favor of proceeding with
the Application.
My question to you is, should I concentrate on the SSA503 Application
for Small Scale Development Amendment to the Future Land Use Map of the
Adopted Comprehensive Plan first, and then later prepare the second step
for the Application for Amendment to Zoning District after the Comp
Amendment passes….
This is really at your choice, but I don’t see any reason not to do them
concurrently. They can be noticed together and run through the hearing
process at the same time.
Or should I (and all 5 owners plus the hotel management) jump through
all the hoops (ie: list of adjacent owners, proof of ownership, 5 copies
of each survey from each owner), with the completed Application for
Amendment to Zoning District Classification simultaneously with the
Application for Small Scale Development Amendment to the Future Land Use
Map of the Adopted comprehensive Plan? Yes, we can generate the list of
adjacent owners if you need some help with that. Do not need five
copies of anything (I have not updated that form in a long time.) In
this case, since we are dealing with defined platted properties, we
probably don’t need surveys, but we will need some proof of ownership
for each property. The most expedient way to proceed is to simply have
all five residential owners and the hotel joined as a single applicant
on one application.
I would greatly appreciate suggested sample language that I can use as a
guideline to describe the specific process that I am requesting my
neighbors to consider. Please reply as soon as possible, as Bill and I
want to distribute the initial letter of intent to our neighbors this
coming week.
Process is: Small scale amendment to the Future Land Use Map of the
Comprehensive Plan to change the map designation from Residential,
Medium Density (RM) to Central Business District (CBD) consistent with
the designation of the Town Center area.
And also a change in Zoning District designation for the same area from
Residential General, Multi-family (RG-M) to Central Business District
(CBD) consistent with the zoning designation of the Town Center area.
In summary, the effect of changing these designations would allow for
the future development/redevelopment of the same kinds of uses that are
in Town Center (but not the more intense General Commercial uses.)
Sec. 24-114. Central Business District. (CBD)
(a) Intent. The Central Business District is intended for low
intensity, neighborhood scale commercial and retail and food service
Uses, and Professional Offices, which are suitable within the
constraints of the existing Development patterns of the District and
which contribute to the commercial, civic and cultural vitality of the
City of Atlantic Beach Town Center area. The Central Business District
contains an established Development pattern with a predominance of older
Structures built prior to the current requirements for area, setbacks,
parking and other site related elements, and this character should be
retained.
And to important to be sure that all parties understand that existing
residential would continue to be “lawful permitted uses” and replaceable
if desired by a property owner. These provisions are already in City
Code, but for peace of mind, I would put a provision within the
ordinances that clearly states this in the case that future parties got
any “wild ideas.”
