121 Levy Road UBE-2006-05 Staff Report CDB COMMUNITY DEVELOPMENT STAFF REPORT October 17, 2006 Public Hearing continued from September 19, 2006 Public Hearing UBE-2006-05, Christopher Wilson (CW Specialties) To: Community Development Board From: Community Development Department Date: August 31, 2006 Subject: UBE-2006-05 Applicant: Christopher Wilson (dba CW Specialties) 121 Levy Road Atlantic Beach, Florida 32233 Request: Request for a Use-by-Exception for a welding shop with mobile welding services in the ILW Zoning District, to be located within an existing multi-tenant facility (Atlantic Beach Commerce and Storage Center) occupied by other light industrial and warehouse uses and located at #121 – 97 Levy Road. Existing Zoning: Light Industrial and Warehousing (ILW) Future Land Use: Light Industrial STAFF COMMENTS The ILW regulations provide for consideration of welding shops as a permissible Use-by-Exception within the Light Industrial and Warehousing district. The subject location is a fully developed property with other similar uses having long occupied this facility. Sec. 24-112. Industrial, Light and Warehousing Districts. (ILW) (c) Uses-by-Exception. Within the ILW Zoning Districts, the following Uses may be approved as a Use-by-Exception. (6) Welding shops, metal fabrication and sheet metal works. The ILW district is intended for light manufacturing, storage and warehousing, processing or fabrication of non-objectionable products, not involving the use of materials, processes or machinery likely to cause undesirable effects upon nearby or adjacent residential or commercial activities. The applicant has provided that his business is primarily mobile welding services. Staff recommends approval finding the requested Use-by-Exception consistent with other uses in this facility and the surrounding area and also consistent with the intent of the ILW Zoning District. SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to recommend approval to the City Commission of a requested Use-by-Exception for a welding shop with mobile welding services in the ILW Zoning District, within the Atlantic Beach Commerce and Storage Center located at #121 - 97 Levy Road, provided: (Provide findings of fact similar to the following.) Approval of this Use-by-Exception complies with the requirements of Section 24-63 of the Land Development Regulations. The requested use is consistent and compatible with other uses in this facility and the surrounding area and also the intent of the ILW Zoning District. SUGGESTED ACTION TO RECOMMEND DENIAL The Community Development Board may consider a motion to recommend denial to the City Commission of a requested Use-by-Exception for a welding shop with mobile welding services in the ILW Zoning District, within the Atlantic Beach Commerce and Storage Center located at #121 - 97 Levy Road, provided: (Provide findings of fact similar to the following.)
