ORDER GRANTING VARIANCE
The above referenced Applicant requested a Variance from Section 24-105 (e) (1) to reduce the required twenty (20) foot front yard to sixteen (16) feet to allow for the reconstruction
of a front porch.
On October 15, 2002, said request was considered at public hearing by the Community Development Board for the City of Atlantic Beach. Having considered the application and supporting
documents and statements made by the Applicant, the Community Development Board found that the request complies with Section 24-49 and Section 24-64 the City of Atlantic Beach Zoning
and Subdivision Regulations, and granted an amended request providing for a lesser amount of Variance, finding as follows:
Special conditions and circumstances exist which are peculiar to the Land, Structure or Building involved and which are not applicable to other Lands, Structures or Buildings in the
same Zoning District;
The special conditions and circumstances do not result from the actions of the Applicant;
The Variance granted is the minimum Variance that will make possible the reasonable Use of the Land, Building or Structure;
The granting of the Variance will be in harmony with the general intent and purpose of this Chapter and the Variance will not be injurious to the area involved or detrimental to the
public welfare.
NOW THEREFORE, based on said findings, the Community Development Board hereby GRANTS a Variance from Section 24-105 (e) (1) to reduce the required twenty (20) foot front yard to allow
the existing front porch to be reconstructed in its current location, not to exceed the limits and dimensions as depicted on the current survey dated September 03, 2002, and as included
with the application for property located at 544 Ocean Boulevard.
