60 Ocean Boulevard ZVAR-2001-01 Staff Report COMMUNITY DEVELOPMENT STAFF REPORT August 21, 2001 Public Hearing ZVAR-2001-01, Jubran Variance To: Community Development Board From: Planning, Zoning and Community Development Department City of Atlantic Beach Date: August 10, 2001 Subject: ZVAR-2001-01 Applicant: Jubran Investments 454-8 St. Augustine Road Jacksonville, Florida 32207 Requested Change: Variance to reduce a required twenty (20) foot front yard setback. Location: 60 Ocean Boulevard Existing Zoning: Commercial General (CG) Future Land Use: Commercial Surrounding Zoning: CG and RG-2 Surrounding Land Use: Commercial consisting of retail, hotel and restaurant. STAFF COMMENTS The Applicant has requested a Variance to reduce a required side yard setback for the purpose of allowing an elevator shaft to encroach a distance of eight (8) feet into a twenty (20) foot required front yard setback in association with the redevelopment of this commercial property, known as the Ocean View Motel, located at 60 Ocean Boulevard. The Applicant has provided that the configuration of the existing structure, which is undergoing renovation for use as a office and retail spacel, presents practical difficulties in placing an elevator on the interior of the building. (Current ADA Accessibility Guidelines require the provision of an elevator.) The Applicant has also provided that the proposed location of the elevator on the north side the building will provide for safer pedestrian access between the parking area, sidewalks and entry to the building from the north. Provided that the Community Development Board, finds that requested Variance complies with Section 24-49 of the Zoning and Subdivision regulations, Staff has no objection to approval of the requested Variance. SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to approve a Zoning Variance to allow an external elevator shaft to encroach a distance of eight (8) feet into a required front yard, as generally depicted on the attached site plan, provided: (Provide findings of fact similar to the following, and attach conditions as may be appropriate.) Approval of this Variance is in compliance with the requirements of Section 24-49, Zoning and Subdivision Regulations for the City of Atlantic Beach. The request is not contrary to public interest and is not detrimental to the health, safety and welfare of general public and those working in the area. Granting of the requested Variance will not be contrary to the public interest, and because of special conditions, the enforcement of the required ten (20) foot front yard setback would create an undue hardship. The request is not in conflict with the City’s Comprehensive Plan. SUGGESTED ACTION TO RECOMMEND DENIAL The Community Development Board may consider a motion deny a Zoning Variance to allow an external elevator shaft to encroach a distance of eight (8) feet into a required front yard, provided: (Provide findings of fact similar to the following.) Approval of this Variance is not in compliance with the requirements of Section 24-49, Zoning and Subdivision Regulations for the City of Atlantic Beach because___________. The request is contrary to public interest and may be detrimental to the health, safety and welfare of general public and those working in the area because _____________________. Granting of the requested Variance is contrary to the public interest, and the applicant has not demonstrated and undue hardship resulting from enforcement of the regulations, which require a ten (10) foot side yard setback.. The request is in conflict with the City’s Comprehensive Plan because _______________.
