Dear Mr. Frosio:
As a follow-up to our earlier discussions, I have enclosed the applicable regulations related to the Subdivision Waiver process and lot size requirements. To assist with your request,
I have provided an application form, which needs to be submitted to the City by July 26th, if you wish the request to be considered at the August 9th City Commission meeting.
As we have discussed, Section 24-255 (a) of the Subdivision regulations requires all newly created residential lots to have a width of not less than 75 feet and lot area of not less
than 7,500 square feet. (This is not a new requirement, but has been contained within the City’s zoning regulations since at least January 26, 1970.)
The subject property is a previously un-platted parcel located within the RS-2 Zoning District and the RL (Residential, Low Density) Comprehensive Plan land use category. Both of these
designations require a larger lot size than the two 50-foot wide by 100-foot deep lots you have proposed. The only process through which the lot size requirement may be changed is
through the Subdivision Waiver in accordance with Section 24-191. You certainly have the right to make this request of the City Commission, but I must be frank in advising that, based
upon previous actions of the Commission, the request is not likely be approved. Please demonstrate within your application, and as thoroughly as possible, how the conditions necessary
