M>/MORANDUM
TO: The Honorable Mayor
and Members of the City Commission
FROM:
City
SUBJECT: Follow-u~ items from Commission meetings
The following are responses to questions and requests for additional information that
were made at recent City Commission meetings:
Landscaping along Seminole Road; A question was raised about the possibility of
landscaping along the section of Seminole Road adjacent to the ditch which runs from
Country Club Lane to Saturiba Drive. Staff pointed out that some utility conflicts may
exist and plantings may conflict with a proposed plan to install a guazd rail. After
research, the City has determined that there is an eight inch water main located
approximately four feet from the edge of pavement from Country Club Lane to 17th
Street. From 17~` Street North to Saturiba Drive there is only an abandoned sewer force
main which would not conflict with landscaping. Plans for a guard rail can be adjusted to
work around various landscaping schemes.
It is possible to create a landscaping plan to improve the looks of this area by working
around the existing utilities. Because of the utilities and other issues, it may not be
possible to have a uniform planting where each block resembles the next, but the use of
similar materials in a more natural and less regimented scheme may accomplish the
desired effect.
Tree Ordinance; Recently some confusion arose about whether the City of Atlantic
Beach was covered by the provisions of the Tree Preservation Ordinance. There is a
section in the Ordinance that exempts the City from obtaining a permit to remove, trim,
prune, cut, or disturb the roots of any tree within a public easement or right-of--way.

However, it is the City Attorney's opinion that the City would need to obtain permits for
tree:removal in other areas. The renovations at Bull Park are an example of where the
City must obtain a permit from the Tree Board.
