Exh 7AAGENDA ITEM NO. 7 /~ DATE: 3 '' I ~ - OO CITY OF ATLANTIC BEACH CITY COMMISSION MEETING STAFF REPORT AGENDA ITEM: Ordinance No. 95-00-73 Amending Tree Protection Ordinance SUBMITTED BY: George Worley, Community Development Director ~ ,i DATE: March 6, 2000 BACKGROUND: Several weeks ago Staffwas contacted by Commissioner Mitchelson with a request to draft language that could be adopted changing the Tree Preservation Ordinance to permit the use of Tree Mitigation funds to provide trees to private property owners. Based upon recommendations from the Beautification Committee, the attached ordinance permits up to $2000 of the Tree Mitigation Fund monies to be used each year to provide trees to private property owners. Based upon the Beautification Committee's meeting minutes, it is anticipated that this would be accomplished through an annual tree give-away event. The ordinance language requires that an area be designated by the City Commission as being "substantially deficient in tree canopy" to permit expenditure of Tree Mitigation Funds on private property. Once such an area has been designated residents of that area would be eligible to participate in any annual tree give- away event or program subsequently established by the City Commission. BUDGET: Annual budget of not more than $2000 from Tree Mitigation Funds. RECOMMENDATION: Pass Ordinance 95-00-73 on~first reading and set a public hearing. Y BE IT ENACTED BY THE CITY COMMISSION ON BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. The Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended by adding a new section to be numbered Section 23-17(e)(3), which section shall read. as follows: "(3) Tree replacement fund monies may be expended by the city for funding public tree planting projects. Eligible tree planting projects may include projects on private property but only on properties where the City Commission has determined that there is a substantial deficiency in tree canopy. Disbursement of Tree Replacement funds for private property projects may not collectively exceed $2,000 annually. Up to ten percent (10%) of each approved project budget may be used for associated soil preparation materials and mulch." SECTION 2. This Ordinance shall take effect immediately upon its final passage and adoption. PASSED by the City Commission on first reading this day of , 2000. JENSEN, ESQUIRE City Attorney DRAFT MINUTES OF BEAUTIFICATION COMMITTEE ~ February 9, 2000 A regular meeting of the Beautification Committee was held Wednesday, February 9, in the City Hall - Conference Room. Present were June Moms, Chairperson, Mimi Ames, Barbara Bonner, Steve Geuther, Gloria Vaughn, Jane Vincent and Staff Member Susan Dunham. I. ' =Call to Order The meeting was called to order by Chairperson June Moms, at 7:40 p.m. . II. Approval of Minutes Bazbara Bonner motioned to approve the Minutes of January 12, 2000, as submitted; Jane Vincent seconded and the motion carried. III. Old Business A. Arbor Day Program: Susan Dunham gave an update from the January 21 Greenscape meeting: 1. Oceanside Bank is sponsoring the Tree Sale. , 2. Greenscape has secured the Pic N-Save parking lot as the location for the event. ' 3. Free mulch will be available for tree sale patrons. _ 4. The next edition of Tide Yiews will contain an article detailing the event. 5. Greenscape requested that the Beautification Committee distribute flyers to the local elementary schools. The Beautification Committee members agreed. Steve Geuther will clarify a target date for distribution at the next Greenscape meeting. 6. Camille Hunter, Clean It Up-Green It Up, two nursery personnel and a forestry person will attend the event to answer questions. 7. The next Greenscape meeting is scheduled for Friday, February 11. B. Ron's Update on Landscaped Areas: Ron Schiebler was not in attendance due to illness. Susan Dunham advised the Committee that the Mayor's live oak tree has been planted. Also, the trees on Saturiba and Plaza have been planted. Discussion was held on how to water the new trees once Ron Schiebler retires from the ' City. Steve Geuther volunteered to talk with the neighboring property owners on Saturiba to see if they would consider watering the trees. Susan Dunham will talk to Public Works to see if they - can water the trees on Plaza.. - C. Tree Giveaway: Susan Dunham distributed the Staff Report (attached) to be submitted to the City Commission for approval. Jane Vincent moved to approve the Staff Report as submitted. Steve Geuther seconded the motion, which passed unanimously. D. Landscaping of Lifeguard Station: Susan Dunham distributed the conceptual plan of the landscaping for the lifeguard station (attached). Steve Geuther approved the landscaping plan as submitted; Gloria Vaughn seconded the motion, which passed unanimously. E. Street End/Beach Access Program: Susan Dunham suggested that this item be tabled until further review of the program by the City Manager. ,. ,. IV. STAFF REPORT AGENDA ITEM: Request from Beautification Committee to hold annual tree giveaway using Tree Fund monies. SUBMITTED BY: Susan Dunham, Beautification Coordinator DATE: February 9, 2000 BACKGROITND: ~ The Beautification Committee would like to hold an annual tree giveaway to attempt to create a tree canopy in City of Atlantic Beach neighborhoods such as Royal Palms, Aquatic Gardens and certain areas of Section H. Approximately $2,000 per year would be allotted from the Tree Fund to purchase live oaks and sycamores to plant on private property. This request would require amending the Tree Ordinancc to allow trees purchased with Tree Fund monies to be planted on privateā€¢ property. City of Atlantic Beach meter readers will be requested to place door hangers with application forms in targeted areas. Applications will be approved in the order in which they are received until all the. allotted trees are given away. The Beautification Department will deliver the trees (with instructions for care) to the owner and it will be their responsibility to plant and care for the trees. RECOMMENDATION: If the Tree Ordinance is amended to allow trees purchased with Tree Fund monies to be planted on private property, it is recommended that the Beautification Committee be allowed to hold an annual tree giveaway. Approximately $2,000 per year would be used from the Tree Fund to purchase trees for the tree giveaway. SUBJECT: Amendme t to tree replacement fund requirements Attached for your review and comment is a copy of a proposed amendment prepared by George Worley to allow for the expenditure of tree replacement fund monies on private property with certain limitations. This has been prepared following the discussion at the City Commission meeting on 2/28/00. George indicated that he had recently received information about the Beautification Committee meeting when the subject was discussed and that the issue of the $2,000 cap was recommended by the Committee after one or both of you had left the meeting. You will also notice that there is no reference to the Beautification Committee's approval - prior to expenditure of tree replacement fund monies in this provision. This is consistent with the other portions of the tree replacement fund ordinance. There is no requirement for Beautification Committee approval prior to the expenditure of any of those funds. However, it has been the City's practice to present proposed projects to the Beautification Committee and to solicit their input on new projects. There is no intention of changing that practice.
