15 Simmons Road UBE-2002-06 Staff Report CDB  COMMUNITY DEVELOPMENT STAFF REPORT September 17, 2002 Public Hearing Use-by-Exception, UBE-2002-06 To: Community Development Board From: Planning, Zoning and Community Development Department City of Atlantic Beach Date: September 09, 2002 Subject: UBE-2002-06 Applicant: Jerry Hoey Beaches Woodcrafts 1936 Beach Avenue Atlantic Beach, Florida 32233 Requested Change: Request for a Use-by-Exception to allow development of a custom cabinet and woodcrafts shop, with associated limited warehousing and office use, all within an enclosed, new 15,000 square foot building. Location: Southeast corner Mayport Road and Church Road (15 Simmons Road) Existing Zoning: CG (Commercial General) Future Land Use: CG (Commercial General) Surrounding Zoning: CG and RG-2 Surrounding Land Use: Various commercial uses and some residential. STAFF COMMENTS AND RECOMMENDATION This request seeks approval of a Use-by-Exception to allow for the relocation of an existing custom cabinetry and woodcrafts business with associated office and limited warehousing use. The proposed business will occupy a new 15,000 square foot building. All business related activities will occur indoors, and there will be no outside storage on the site. Development of the site shall be subject to all permitting requirements including landscaping, any required buffers, stormwater management and parking and the amended sign regulations. This section of Mayport Road consists of various relatively high intensity commercial uses, although there are also residential uses in this area. It is Staff’s opinion that the proposed use is consistent and compatible with surrounding uses, and that this use is of a less intense character than other by-right Permitted Uses in the CG Zoning District. Staff finds that the request complies with Section 24-63 and recommends approval of the requested Use-by-Exception, subject to the following conditions: no chain link, or similar type of fence will be installed on the westernmost side of the property which adjoins Mayport Road; any such fencing will be limited to that as shown on the site plan submitted with this application, all exterior lighting shall be directed towards the site and shall not illuminate adjacent residential parcels. SUGGESTED ACTION TO RECOMMEND APPROVAL The Community Development Board may consider a motion to recommend approval to the City Commission of the requested Use-by-Exception to allow a custom cabinetry and woodcrafts shop, with associated limited warehousing and office use on property located at the southeast corner Mayport Road and Church Road (15 Simmons Road) as described by legal description within the application, provided: No chain link, or similar type of fence shall be installed on the westernmost side of the property which adjoins Mayport Road, and further any such fencing shall be limited to that as shown on the site plan submitted with this application. all exterior lighting shall be directed towards the site and shall not illuminate adjacent residential parcels. All business activities shall be maintained within the enclosed building, and there shall be no outside storage of any goods or materials. (Provide findings of fact similar to the following, and attach other conditions as may be appropriate.) Approval of this Use-by-Exception is in compliance with the requirements of Section 24-63, Zoning and Subdivision Regulations for the City of Atlantic Beach. The request is not contrary to public interest and is not detrimental to the health, safety and welfare of general public. The proposed use is compatible with adjacent properties and other properties within the surrounding area. The proposed use is not in conflict with the City’s Comprehensive Plan and is consistent with the Commercial General Future Land Use designation.
