645 Ocean Boulevard ZVAR-2003-10 RE Variance requestMr. and Mrs. Lackie, Pursuant to below Section 24-82 (c), the maximum permitted height of any new construction on your lot will be limited to 28 feet. Your lot is a nonconforming lot of record, containing 81% of the minimum required 5,000 square foot of lot area. As such, you are limited to 81% of the standard 35-foot height limit. (A Zoning Variance cannot increase Maximum Height of Building within Residential Zoning Districts.) It is possible to get three stories within 28-feet, but in the event that your Variance request is approved, be sure that your architect or designer is aware of this height limit. Sec. 24-82. General Restrictions upon Land, Buildings and Structures. (c) Height. No Structures or Building shall be erected, and no existing Building shall be moved, reconditioned or structurally altered so as to exceed the height limit specified in this Chapter for the Zoning District in which such Building or Structure is located. However, on Nonconforming Lots of Record, the Height of Buildings shall be restricted to a percentage of the area of the such Lot compared to the minimum requirements of the Zoning District and applying the same to the maximum Building height allowed in said Zoning District. (For example, if the Minimum Lot Area is 5,000 square foot, and the size of the Nonconforming Lot is 2,500 square feet, a percentage of 50 percent would be applied to the 35-foot height restrictions, resulting in an allowable Building height of seventeen and one-half (17.5) feet.
