ORDER CONFIRMING APPROVAL OF WAIVER 16-SAFW-133 WITH CONDITIONS
This matter came to be heard upon the application for a waiver from the Land Development Regulations to allow body piercing at 469 Atlantic Boulevard, Unit 11 with the legal description
of Saltair Section 3, Lots 810 to 816 and 838 to 840 by Georgina and John Salzer operating as “Pure Imagination” on July 25, 2016.
Having duly considered the application for waiver, supporting documents and comments by staff, the applicant, and members of the public at the public hearing on September 12, 2016,
the City Commission of the City of Atlantic Beach hereby,
FINDS AND DETERMINES:
That the strict prohibition of body artists in Section 24-111(b) of the Land Development Regulations is in conflict with the public interest.
NOW, THEREFORE, it is ORDERED by the City Commission:
The application for waiver is hereby APPROVED WITH CONDITIONS voluntarily offered by the applicants as follows:
That the business remain in compliance with Chapter 64E-19 of the Florida Administrative Code;
That the waiver is granted to Georgina and John Salzer only and shall not run with the title to the property;
That no smoking paraphernalia will be sold at the business; and
That the business must close by midnight every day.
Approved by the City Commission on September 12, 2016.
