The Community Development Board, at their June 18, 2002 meeting, found that continuation of three units on this property is consistent with the adopted Comprehensive Plan in that three units existed prior to the adoption of the Comprehensive Plan, and that no increase in density is proposed. The Board further recognized that the reconfiguration of the existing two lots as you have proposed is consistent with the City's subdivision regulations, and a re -plat is not required in that no new additional parcels will be created, and there is no change to streets other than private driveways. Based upon our recent meeting, your intent remains the same as proposed to the CD Board, which is to convert the existing three -unit structure into two a two -unit dwelling, which shall be located on one lot, and to construct a new single - family residence on the second lot. This plan of development is consistent with the decision of the Community Development Board, and such development may proceed, subject of course, to all other applicable permitting requirements such as building setbacks and compliance with all Florida Building Codes. RG -2 (Residential, multi - family) Residential, Low Density RS -2 (Residential, single - family) Residential STAFF COMMENTS AND RECOMMENDATION This request involves an appeal of a decision by the Community Development Director, such decision finding that the proposed reconfiguration of two existing platted Lots of Record and the anticipated future development upon the resulting two lots is not in compliance with the Comprehensive Plan. The subject property involves Lots 1 and 3, within Block 8 of Subdivision A. The original Lots of Record are 50 -foot wide by 150 -foot deep lots, although a portion of Lot 1 was conveyed to the City of Atlantic Beach as right -of -way, and a portion of the western length of Lot 3 was conveyed to adjoining Lot 5. (In other words, ownership of these two platted Lots of Record is divided between three owners.) These two lots are presently developed with a detached garage and a three -unit multi - family structure. It is the Community Development Director's position that these two lots should be considered as one development parcel in that the existing three -unit structure has been constructed across the lot line that divides Lot 1 and Lot 3. The property is located in a Residential, Low Density Comprehensive Plan future land use category, which allows a maximum of six dwelling units per acre. The two existing parcels contain 15,000 square feet of combined lot area, which under current regulations, would allow two dwelling units. Accordingly, the existing three units are legal nonconforming uses in that these were developed prior to adoption of the 1990 Comprehensive Plan. The applicant wishes to reconfigure the two existing lots, so that the two new lots would front on East Coast Drive rather than Seventh Street. The three unit multi - family structure would remain on a separate new corner lot, and the applicant proposes to construct a single - family residence on the new interior lot, which would result in a total of four dwelling units on the two combined original parcels. While it appears that the original two lots can be reconfigured in compliance with the subdivision regulations and lot area requirements, the applicant has been advised that development of an additional dwelling unit is not consistent with the Comprehensive Plan, and that the proposed single - family residence could not be constructed on the resulting new vacant lot. (The property owner has stated that it would be his intent to demolish the small detached garage.) The South Lot to be 60 feet wide on East Coast Drive and 100 feet deep on the South Property Line. Total square footage of this Lot to be 5,790. This Lot to incorporate a new single family residential structure configured so as to meet the current Zoning Requirements. As you can see, there are two portions of the existing Survey that are a part of the Public Street and a driveway access at the existing West property line. We feel that a hardship exists in that Mr. and Mrs. Winfree purchased the property many years ago and could have re- configured this property and met the City requirements prior to the enactment of the Comprehensive Plan. April. 11, 2002 Bill Winfree 680 East Coast Drive Atlantic Beach, Florida 32233 RE: Reconfiguration of Lots 1 and 3, Block 8, Subdivision A Dear Mr. Winfree: 1 have reviewed the proposed reconfiguration of your two 50 -foot by 150 -foot platted lots located at the southwest corner of Seventh Street and East Coast Drive. Section 24 -188 of the subdivision regulations allows for the reconfiguration of such lots without the requirement to re -plat, provided that no additional lots are created and further provided that there are no change to streets or access points other than private driveways. The lots and any future construction must also comply with other applicable zoning regulations, Florida Building Code requirements and the adopted Comprehensive Plan. There is, however, a conflict with developing an additional dwelling unit on this property. (It is my understanding that you wish to maintain the three multi - family units on the north portion of the property and then construct a new single - family residence on the southern portion of the property.) The two existing lots have been developed as one development parcel. Additional dwelling units (either single- family or multi- family) cannot be added to the property since it already contains more units than allowed by the low density Comprehensive Plan designation, which allows a maximum of six dwelling units per acre.
