Request: Request for a variance as permitted by Section 24-64, to decrease the side yard setback from
10 feet as required by Section III of the Selva Marina Unit 12-C PUD to 5 feet and decrease
the rear yard setback from 20 feet as required by Section III of the Selva Marina Unit 12-C
PUD to 7 feet, 10 inches to allow a screen enclosure at Selva Marina Unit 12-C Lot 4 C aka
1865 Live Oak Lane).
Summary: The applicant is requesting to constmct a screen enclosure in their rear yard around a new
pool and outdoor area. The screen enclosure would be 5 feet from their southern side
property line and 7 feet 10 inches from their rear property line. The property is located in
an area zoned Planned Unit Development CPUD) that has its own unique setback
requirements. The proposed setbacks meet the requirements of the City for non-PUDs, but
not the requirements of the PUD where screen enclosures are considered part of the house.
Pursuant to Section 286.0105, Florida Statutes, a person deciding to appeal any decision made by the Commission with respect to any matter considered at the meeting
or at any subsequent meeting to which the Commission has continued its deliberations is advised Ulat such person will need to insure that a verbatim record of all
proceedings is made, which must include the testimony and evidence upon which the appeal is to be based.
