BACKGROUND: In reviewing the arrang ments for the proposed trip to
Orlando of Teen Council members and adult volunteers, City
Staff determined that significant problems existed with the
structure of the Teen Council that limited the availability of
City insurance coverage for Teen Council events and made
the organization difficult or impractical to operate under
Florida Law.
A meeting was held with Mayor Meserve, James Fletcher
(Adult Advisor to the Teen Council} and Jim Hanson to
discuss the structural~problems and other issues. The
outcome of the meeting was for the City Staff to draft a
resolution which would restructure the Teen Council.. The
biggest change is for the Teen Council to self-appoint their
own members. Thus, the City Commission will not have to
appoint members (which it has not done since the Teen
Council's creation in 1994) and the new Teen Council will
not be required to comply with all Florida Statutes for
meetings of public bodies. The only appointments to
be made by the City Commission will be a primary adult
advisor and a City Commissioner as liaison to the Teen
Council.
This draft resolution has been reviewed by Mayor Meserve,
James Fletcher, and Alan Jensen.
BUDGET: No budget impact is anticipated by this action.

A RESOLUTION OF ATLANTIC BEACH CITY
COMMISSION, RESCINDING ALL PREVIOUS
LEGISLATION REGARDING THE ATLANTIC BEACH
TEEN COUNCIL; CREATING A NEW TEEN COUNCIL;
PROVIDING FOR QUALIFICATIONS; PROVIDING FOR
DUTIES, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on September 12,1994, the City Commission adopted Resolution 94-30
creating the Atlantic Beach Teen Council; and
WHEREAS, the City Commission continues to support the Teen Council but desires
to change the parameters under which the Teen Council operates.
NOW, THEREFORE, be it resolved by the City Commission of the City of Atlantic
Beach, as follows:
SECTION 1. All previous legislation providing for the creation and conduct of the
Atlantic Beach Teen Council is hereby rescinded.
SECTION 2. Creation, Composition; Qualification
There is hereby established a Teen Council all members of which will be at least thirteen
(13) and no more than nineteen (19) years of age, shall be residents of the city, and shall
serve without compensation. Each member shall submit his/her name, address and
telephone number to the city.
SECTION 3. Adult Advisor; Commission Liaison
The Mayor shall designate one City Commissioner to serve as liaison to the Teen Council.
Also, an adult advisor to the Teen Council shall be appointed by the City Commission and
shall serve as the primary adult advisor. Additional adult advisors may volunteer to work
with the Teen Council under the supervision of the primary advisor, and at least one adult
advisor must be in attendance at all meetings.
SECTION 4. Duties
The Teen Council shall make recommendations in writing to the Recreation Director and the
Commission Liaison on all Teen Council activities and programs sponsored and/or funded
by the city, and such recommendations shall be considered by the city.
SECTION 5. Organization; Officers
The Teen Council shall have the authority to organize themselves and appoint a chairman,
vice chairman, and any such officers as they deem advisable. Furthermore, the Teen Council
may draft a mission statement and by-laws to govern the conduct of their business, both of
which shall be approved by the City Commission.
SECTION 6. Liability to City
The city shall consider recommendations for fiinding of events proposed by the Teen
Council, but nothing in this Resolution or otherwise shall be construed as authorizing and
empowering the Teen Council to impose any liability of any nature, financial or otherwise,
upon the city, without city approval.
SECTION 7. This resolution shall take effect immediately upon its final passage and
adoption.
