The subject property is designated as Residential, High Density (RH) as shown on the adopted
Future Land Use Map, and is located in the Residential, General, Multi -Family (RG -2) Zoning
District, as shown on the adopted Zoning Map. According to the provisions of Section 24-
108(b)(7) of the Zoning, Subdivision and Land Development Regulations (LDR) of the City of
Atlantic Beach Code of Municipal Ordinances, "Family Day Care Homes" and "Group Care
Homes" (also known as Assisted Living Facilities) are permitted within the RG -2 Zoning
District.
The following definitions from Section 24-17 of the LDR further define such facilities:
Family Day Care Home shall mean as defined by State law. (See also Group
Care Home.) Pursuant to Chapter 166.0445, Florida Statutes, the operation of a
residence as a Family Day Care Home registered and licensed with the
Department of Children and Family Services shall constitute a permitted
residential Use and shall not require approval of a Use -by -Exception.
Group Care Home shall mean any Dwelling, Building or other place, occupied
by seven (7) or more persons, including staff, whether operated for profit or not,
which provides for a period exceeding twenty-four (24) hours, one or more
personal services for persons not related to the owner or administrator by law,
blood, marriage or adoption, and not in foster care, who require such services.
The personal services, in addition to housing and food services, may include but

not be limited to personal assistance with bathing, dressing, housekeeping, adult
supervision, emotional security, and other related services but not including
medical services.
According to the Property Appraiser's Office, there are two (2) townhouses, each consisting of
three (3) bedrooms and two (2) bathrooms, located on this property. Therefore, the capacity for
such a facility would be a total of twelve (12) persons, or two (2) persons per bedroom.
Once you receive your license from DCF, you will need to apply for a local business tax receipt
(formerly known as an occupational license) through the City Clerk's office, also located in City
Hall. During this process, the Fire Marshall and the Building Official will inspect the premises
for compliance with safety and ADA regulations, as well as Florida Building Code and
International Property Maintenance Code. Additionally, Planning & Zoning will also be
required to sign -off on that form as well.
