AN ORDINANCE OF THE CITY OF ATLANTIC `~ ~' ~d r ~d
BEACH, FLORIDA, CLOSING, VACATING AND
ABANDONING CERTAIN PORTIONS OF GLADIOLA
• STREET SOUTH OF WEST PLAZA, AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Atlantic Beach has determined that it is in the best interest
of the City to close, vacate and abandon those portions of Gladiola Street south of West
Plaza; and
WHEREAS, it is further the desire of the City Commission of the City of Atlantic
Beach to transfer title to the abandoned right-of--way of Gladiola Street to the adjoining
property owners.
NOW THEREFORE, BE IT ORDAINED by the City Commission of the City of
Atlantic Beach, Florida:
SECTION 1. The City does hereby close, vacate and abandon all right, title and
interest to those portions of Gladiola Street, south of West Plaza to its southern termination,
as more particularly shown on the attached map.
SECTION 2. It is the intent of the City that title to said portions revert to the
adjoining property owner, or owners, by virtue of the adoption of this ordinance.
SECTION 3. This Ordinance shall take effect immediately upon its final passage
and adoption.

Subject: Request to abandon Gladiola Street south of West Plaza
Dear Mr. Hanson,
As per our conversation at the end of last week, I am submitting the current survey of my
property that I received in the closing documents. The survey dates January 26, 2000.
According to the scale indicated on the survey (1" equals 60') I have indicated in red our
revised property offer for trade. You will notice that I have included an extra 10 feet of
our property making the total that we are offering to trade 60 feet. Simply stated I am
offering you 60 feet in exchange for'S0 feet.
I feel that this will fairly compensate the city of Atlantic Beach for the property that we
are asking you to abandon. You will notice on the survey that I indicated the
southeastern property marker in red. The extra 10 feet will assure that there will be room
for vehicle access all the way out to the water. There is more dry Iand available than the
survey shows.
This exchange should eliminate the need for an appraisal on the lot that is being
abandoned on my behalf, as we are trading property for property. We paid 50,000.00 per
block without any regard to whether it was creek/swamp property or not. Since the city
did not pay the original owner for the property, this puts the city on the plus end of the
trade financially. There is also other access in the area west of parcel 171 that would be
better access as the creek is deeper and broader.
I am also making this offer in an attempt to expedite the process. I cannot proceed with
my over-all site plans until this issue is settled, executed in writing, resurveyed, and
retitled. I cannot proceed with well and septic tank permits until I can submit approved
site plans. This leaves me in an awkward situation with my bank, as my construction
loan is directly tied into my lot loan. I feel that we have been patient, considerate, and
reasonable. I am asking that the commission move forward at the next meeting, April
10~` with a vote in my behalf.
