To be honest, I'm not sure what 1,140 c/f of water retention means. I want to make sure that everything is done correctly with the our home and families safety in mind. We want to make sure the city's codes are met and we do not have issues with erosion near the house or soft spots throughout the back. Is there anyone that can come out and show me what we need to do or can I come in and meet with someone to make sure we do everything correctly? Because of the stop work notice, the landscaper will not come back out until we have specific requirements from the city, so I want to make sure I pass along accurate information. I remember your house well. I actually have similar pictures of your house after the storm that I took during our survey of the city. I also remember getting a call from the original buyer of the house (I don't know if that was you'll or not)asking me if there was anything they could do with the back yard and how the water retention was put in by the contractor. Because this house was built on a vacant lot when it was first built back in 2016/2017 the contractor had to do water retention for the entire building and all impervious area. What was required was 1140 c/f of water retention. On the original building plan that was turned in they had a 47'X 27' of back yard area that should have been down 1' deep. This was to meet the water retention requirements for the city.This was designed by the builder not the city. But it did meet our requirements. The STOP WORK ORDER was placed by Angelia because the required water retention was being filled up.The city does not allow fill dirt to be brought in unless it had been previously approved. The 1140 C/F of water retention would have to be reinstalled and approved. I hope this answers any of your questions. I spoke with Angela earlier today regarding the "Stop Work" notice for our lawn renovation. Again, we're sorry for the inconvenience and did not know we were in violation of anything. We are renovating our lawn because of all the trees that fell during Irma. Originally,the yard was very steeply graded around a large hickory, magnolia, and oak tree in our backyard. During Irma all of the trees in the backyard fell except for one oak that is left. The trees fell on the house, and we were forced to move out for a while. The rotting root systems over the last couple of years have caused deep depressions and soft spots that make it difficult to even walk through the yard. I attached some photos. The landscaper recommended bringing in the dirt to try and remedy all of this before we lay sod and an irrigation system. I'm hoping we can find a solution! We're finally ready for a yard our family can use. These standards are set forth in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the City of Atlantic Beach Code of Ordinances in Chapter 6, Article II, Section 6-16. A review of the case file of 967 CAMELIA ST was conducted on 8/19/2020. The City of Atlantic Beach Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances: VIOLATION CODE: Land Development Regulations. Sec. 24-70. - Land clearing and alteration of site grade or topography. No lands shall be cleared, grubbed, filled, excavated or topographically altered by any means, and no vegetation on any parcel or lot disturbed, prior to issuance of all required approvals and development permits authorizing such clearing or alteration. Except as required to meet coastal construction codes as set forth within a valid permit from the Florida Department of Environmental Protection; or as required to meet applicable flood zone or stormwater regulations pursuant to valid permits, the grade, elevation or topography of any parcel, development or redevelopment site shall not be altered. NATURE OF VIOLATION: On March 2, 2020 a stop work order was posted on the property for filling in the back yard and altering the grade without an approved permit. On March 16, 2020 an application was submitted the City of Atlantic Beach. The application was denied by the zoning department due to the plan not addressing mitigation of the trees that were in the back yard. To date, no revised application has been received and no valid permit exists for the grade alteration to your back yard. This letter requests that the noted violation(s) be corrected by submitting a revised application to address the tree mitigation issues within ten (10) days of the receipt of this notice. Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty dollars ($250.00) per day.
