ORDER GRANTING WAIVERS
On June 27, 2016, a public hearing was held by the City of Atlantic Beach City Commission to
consider an application for two waivers from Section 24-177(c)(4) for landscaping and Section
24-111(g)(1) for impervious surface requirements for the property located at 501/535/541
Atlantic Boulevard, in order for Gate Petroleum to provide thirty (30) parking spaces for the
tenant restaurant. Having considered the Application and Staff Report attached hereto as
Exhibits 1 and 2 respectively and made a part hereof, together with supporting documents and
comments by staff and members of the public, the City Commission GRANTED the following
two waivers, finding the waiver requests to be consistent with the provisions of Section 24-
46(d) of the Land Development Regulations and that the waivers will result in additional
parking, appropriate landscaping and reduced impact on adjacent businesses and
neighborhoods, in conformance with the general intent and spirit of the Land Development
Regulations:
1. Waiver from Section 24-177(c)(4), to delete up to four (4) landscape islands at the end
of parking rows; and
2. Waiver from Section 24-111(g)(1), to increase the amount of impervious surface
coverage from 70% up to a maximum of 75%.
