Good Afternoon Katie,
First off,Welcome to Atlantic Beach. I've always thought that lot was a hidden gem tucked away back there.
I believe you are talking about this section of fence that runs across your north property line that is owned by the
Beaubouef Trust. I checked our records,and I don't see that a permit was ever issued for it. Our first step is to request a
formal fence application with a copy of the survey. Once we have that information we will be able to determine of the
fence can be legally permitted in its current location or if it will need to be moved. I will let you know the results of their
permit application once we have completed the process. Our initial letter gives them 10 days to respond and once they
do,the permit process could take another 10 days. Please feel free to check in with me any time before then to see if
we've heard anything.

Brenna,
My name is Katie Borello. I am a resident of Atlantic Beach and an Assistant State Attorney. I am having an
issue with my neighbor, who constructed a six foot fence that blocks that majority of our view of the
intracoastal. She owns the land, but does not live there. It is a vacant lot that she has had listed for sale for
several years. However, the front of our property is City of Atlantic Beach property because it is technically
the rest of"Lily Street" although the road was never constructed all the way across. Based on the case law
have found, we might not be successful in court because our property is not technically bordered by tidal
waters, because it is the City's property is what borders the tidal waters. I wanted to talk to you to see if the
City would be interested in pursuing this matter, or if there is any way the City can assist me in resolving this
manner. We have tried to speak to the neighbor, but she is unwilling to remove that portion of the fence that
is a nuisance or allow us to pay to have a shorter fence installed there that would allow us to enjoy the view
while still protecting her property line.
I have attached the relevant case law I found on a brief search for your convenience.

construction activities and also maintenance standards for property within the City. These standards are set forth
in the International Property Maintenance Code and the Florida Building Code and were adopted as part of the
City of Atlantic Beach Code of Ordinances in Chapter 6,Article II, Section 6-16.
A code enforcement inspection at 0 GLADIOLA ST was conducted on 3/6/2020. The City of Atlantic Beach
Code Enforcement has found your property to be in violation of the City of Atlantic Beach Code of Ordinances:
VIOLATION CODE: Sec. 24-157. Fences,walls and similar structures.(a) Permit required. Issuance of a
permit is required for any new or replacement fence or wall and walls shall comply with the following provisions.
Nonconforming fences shall not be replaced with nonconforming fences. The term fence and wall may be used
interchangeably within this chapter,and shall mean as specifically defined within section 24-17. Fences must be
constructed out of materials that are customarily used for fences.
NATURE OF VIOLATION: A fence has been installed at the unimproved lots between the marsh and Gladiola
Street.
This letter requests that the noted violation(s) be corrected by obtaining a valid fence permit from the City
of Atlantic Beach and requesting an inpsection to assure the fence meets municipal and building codes
within ten(10)days of the receipt of this notice.
Thank you for your cooperation in this matter. Failure to correct the violation by the required date may result in
this case being referred to the Code Enforcement Special Magistrate resulting in fines up to two hundred fifty
dollars ($250.00) per day. Upon completion of the action required, it is your responsibility to contact me and
arrange for an inspection to verify compliance. Please contact Atlantic Beach Code Enforcement at (904) 247-

Fence at 1300 Gladiola St.
Since we spoke about the above notice, I have gotten a survey, picked up the
necessary forms from the City and am in the process of completing the forms to request
a fence permit.
I've gotten a little delayed because, like everyone else, I am trying to avoid going out
and the permit requires a notary certificate. I will probably try to do this next week
unless more restrictive measures are taken that would prevent me from getting this
taken care of.
