SUBJECT: TREE REMOVAL MITIGATION-455-461 ATLANTIC BLVD(LEWIS)

REQUESTED ACTION: THE APPLICANT IS REQUESTING RECONSIDERATION
OF ASSESSED MITIGATION REQUIRMENTS.
BACKGROUND:
On September 9,2005,an application for tree removal was received by the building department from
Robert Nelson of Garden Room Landscape Design, acting as agent on behalf of property owner
David E. Lewis. The application requested the removal of following from the interior zone: seven
(7) Sabal Palms totaling 116"; two (2) Pines totaling 30" and one (1) 14" Pine that was dead. From
the exterior zone, eight (8) Sabal Palms totaling 126" and one (1) 12" Elm were proposed for
removal. The applicant offered as mitigation the protection of one (1) 12"Laurel Oak and one (1)
18" Live Oak, as well as new plantings of six (6) Sabal Palms, minimum 15" diameter each, twelve
(12) Washingtonia Palms, minimum 15" diameter each, and four (4) Live Oaks, minimum 5.5"
caliper each.
The application was to be reviewed at the September 28th regular meeting of the Tree Conservation
Board. However, due to lack of quorum, the meeting was cancelled. Building Official at that time,
Don Ford,reported to Board Members at the October 12,2005 regular meeting that he had issued a
permit for the requested tree removals.
Permit #05-00031341 was issued by then-Building Official Don Ford on 10/03/05 for the removal
of the following: seven (7) Sabal Palms in the interior zone, totaling 116";eight(8) Sabal Palms from
the exterior zone totaling 126"; two (2) Pine Trees in interior zone totaling 30", one (1) 12" Elm in
exterior zone and one (1) 14"Pine Tree in the interior zone. The following mitigation was assessed:
protection of one (1) 12" Laurel Oak and one (1) 18" Live Oak, and the planting of six (6) Sabal
Palms with a minimum diameter of 15" each; twelve (12) Washingtonia Palms with a minimum
diameter of 15" each; and four (4) Live Oaks, with a minimum diameter of 5.5" each. Assessment
was made at the rate of 1" of replacement, protection or payment into the Tree Fund for each 2"
removed. No mitigation was required for the 14"Pine Tree because it was dead.
A landscape plan, dated 8/2005, and last revised on 10/21/2005 was accepted by the Building
Department and placed in the project file. On that plan there is a box titled"Tree Mitigation", and
within that box is a table documenting pre-tree removal existing conditions as well proposed tree
removal and proposed tree replacement consistent with the tree removal permit application
submitted and described above.
On August 31, 2006, Code Enforcement Officer Alex Sherrer sent a letter regarding unmet
mitigation to Mr. Lewis. Mr. Sherrer noted that all trees had been removed as permitted, but no

mitigation had been accomplished and subsequently, the property had been put up for sale. To
secure trees and/or funds owed to the City, Mr. Sherrer notified Mr. Lewis that a lien in the amount
of $37,674.00 would be placed against the property. [NOTE: $37,674.00 is an incorrect amount.
See staff comments for correct calculation]. Mr. Lewis replied on October 18, 2006, that his
intention was to sell the undeveloped property and meet incurred obligations to the City's Tree
Mitigation Fund. No lien was placed on said property.
STAFF COMMENTS:
Since the issuance of permit #05-00031341, the 284" proposed for removal were removed. In
monetary terms, this would be the equivalent to $16,614.00, based upon the current rate of
$117/inch, derived as specified in Section 23-17 (e) (2) i. Additionally, the two trees designated for
protection as partial fulfillment of mitigation (one 12" Laurel Oak and one 18" Live Oak) have also
been removed,without benefit of permit. Therefore mitigation may be assessed for those trees also,
at the rate of 1:1 [see Section 23-17 (g) (3) b]. In monetary terms, this would be the equivalent of
$3,510.00,therefore bringing the total amount due equivalent to$20,124.00.
As currently written, the tree ordinance contains no special provisions or exclusions for certain
species. That is, there are typically no "discounts" given in mitigation assessment for the removal of
palms, though use of palms is discouraged except as replacements for protected palms. It is the
normal practice of the Tree Board to not assess mitigation for the removal of invasive species, no
matter what size they might be.
SUGGESTED ACTION FOR BOARD CONSIDERATION:
1. The Tree Conservation Board may consider a motion to stand on existing
assessment [equivalent to $16,614.00] for trees removed with benefit of permit, with
no additional mitigation required for additional two trees removed, with the
following recommendations made to the applicant:
a. Should the applicant maintain ownership of the subject property, he will be
responsible for meeting full mitigation obligations by replacing trees and/or
paying into the Tree Conservation Fund by September 31,2009;or,
b. Should the applicant transfer ownership of the subject property, he will meet
full mitigation obligations by paying into the Tree Conservation Fund the
total amount due (above) within 30 days of transfer of ownership of said
property;or,

2. The Tree Conservation Board may consider a motion to increase the existing
mitigation assessment by $3,510.00 to account for the removal of two trees
designated for protection, without benefit of permit, thus resulting in a new total
assessment [equivalent to $20,124.00], with the following recommendations to the
applicant:
a. Should the applicant maintain ownership of the subject property, he will be
responsible for meeting full mitigation obligations by replacing trees and/or
paying into the Tree Conservation Fund by September 31,2009;or,
b. Should the applicant transfer ownership of the subject property, he will meet
full mitigation obligations by paying into the Tree Conservation Fund the
total amount due (above) within 30 days of transfer of ownership of said
property;or,
c. Should the applicant transfer ownership of the subject property, and the sales
contract contain a clause also transferring responsibility for assessed tree
mitigation, then the new owner will be responsible for meeting full
mitigation obligations by replacing trees and/or paying into the Tree
Conservation Fund. Payment in full into the Tree Conservation Fund will be

3. The Tree Conservation Board may consider a motion to reduce the existing
mitigation assessment,based upon the following considerations:
a. The [previously] existing tree canopy of the lot[s];
b. The [previous and future] tree canopy of adjoining lots;
c. The topography of the lot[s];
d. The efforts of the applicant to minimize loss of trees, through the size and
design of the structure;
e. The cumulative effects of tree loss [environmental factors such as "heat
island effect", carbon sequestration; quality of life factors such as scenic
beauty]; and,
f. The consistency of the tree removals with the intent of Chapter 23,Article II
of the City of Atlantic Beach Code of Ordinances,providing that such actions
are not detrimental to the public welfare.
The applicant may appeal any determination or decision of the Tree Conservation Board to
the City Commission. It is requested that such appeals be submitted in writing within 30
days of said determination or decision.

REGULAR MEETING OF
TREE CONSERVATION BOARD
October 12,2005
A regular meeting of the Tree Conservation Board was held on September 14,2005 in the
Adele Grage Cultural Center. Present were Jim McCue,Jamie Fletcher, Stephanie
Catania,Building Official Don Ford and Recording Secretary Amber Lehman. Chuck
Carroll and Maureen Schaughnessy were excused.
1. Call to Order
The meeting was called to order at 7:13 p.m.
2. Recognition of Visitors
Jim McCue recognized KC Quintoff.
KC Quintoff, 544 Plaza Drive, stated that he believes the trees are very important to the
City of Atlantic Beach. Mr. Quintoff asked why the proposed tree ordinance has been
brought to the City Commissioners twice, but has not been voted on. He stated that he
would like to see saving the trees more of a priority of the City Commissioners.
3. Approval of Minutes of the Meeting of September 14,2005
A motion was made by Board Member Fletcher to approve minutes from the September
14,2005 minutes. 2"d by Board Member Catania,unanimously carried.
4. New Business
A. Stormscaping Book
Mr. Ford presented a book about stormscaping. The book will be kept in his
office at City Hall. The book outlines several landscaping ideas for preparing for
hurricanes. This book was recommended by Commissioner Simmons.
B. Proposed Tree Ordinance
Mr. Ford handed out a spreadsheet,which detailed the proposed changes for the
Proposed Tree Ordinance.
There was discussion on the proposed changes.
Mr. Fletcher stated that he had concerns about some of the wording with the
proposed changes. He asked that the board members spend time at the next
meeting defining the changes better.
C. Permits Issued
Mr.Ford stated that due the lack of quorum at the last meeting,he had to issue
two tree removal permits for 455-461 Atlantic Beach Blvd. And 676 East Coast
Drive.
D. Dorothy Kerber Letter
Ms. Catania stated that Dorothy Kerber had written a letter to the Beaches Leader
citing incorrect information on the Proposed Tree Ordinance.
Ms. Schaughnessy(absent from meeting)had prepared a rebuttal to Ms. Kerber's
letter to the Beaches Leader.
Mr. McCue suggested that the board agree to send Chairman Schaugnessy's
response to the Beaches Leader so that it will clear up any incorrect information.
Ms. Catania made a motion to accept Chairman Schaughnessy's response as
written as a rebuttal to Dorothy Kerber's letter to the Beaches Leader,seconded by
Mr. McCue;motion unanimously approved.
