The property is within the Commercial General (CG) Zoning District and is designated as Commercial on the City's Future Land Use Map of the Comprehensive Plan. The development of the Sea Turtle property predates many of our local land development regulations, and I am advised that motels were a permitted use within the CG district at the time the Sea Turtle was constructed; therefore, no Use-by-Exception was required. Regardless, the Sea Turtle Inn property, limited to the hotel and accessory uses and activities, is recognized as a legally vested use for that property. Our City Clerk's office has also researched archived records and can find no record of a Use-by-Exception being approved for the site. The property, to the City's knowledge, is currently in compliance with applicable local Land Development Regulations and Florida Building Codes.
