AGENDA ITEM: Introduction and first reading of Ordinance 90-00-169 amending
Chapter 24, Zoning and Subdivision Regulations.

BACKGROUND:
• Several years ago the Community Development Board suggested that Chapter 24 be reviewed
-- and revised to eliminate conflicting language and to bring the intent and language up-to-date. At
that time the City Commission appointed a citizen committee to conduct this review. For various
reasons the review took many months of effort. Following that review the City Commission
tasked the Community Development Board with conducting its own review. This also took many
months of effort at regular and special meetings. The Board has now concluded its review and
has prepazed an ordinance in draft format underlines for new and strr'ke-through for dele#ed) for
the City Commission to review.
Because of the complicated nature of this ordinance, the Community Development Boazd
recommends the City Commission conduct a first reading and then set a workshop meeting with
the Community Development Board to allow them to answer questions and to discuss the issue of
impervious surface limitations. Because this is a change to the Zoning Code, the final reading of
the ordinance must be set at least 30 days following the first reading. This will allow the City
Commission to thoroughly review the proposed changes and hold a workshop meeting, if so
desired, prior to conducting the Public Hearing. It can also be anticipated that one Public Hearing
may not suffice, given the potential impacts on business and property owners inherent in such an
extensive re-write of such a complicated document.
In an effort to assist the City Commission in its review the Board has requested Staffto create a
~~mmary of the major changes included in the proposed ordinance. This summary is by no means
exhaustive in its presentation of changes, however the azeas with substantial changes have been
noted.

RECOMMENDATION:
The Community Development Board recommends adoption on First Reading and setting of a
Public Hearing. for June 12, 2000. The Boazd also recommends calling a joint workshop between
the City Commission and the Community Development Boazd.

1Vlajor Changes
The Community Development Board has completed its review of Chapter 24, Zoning and
Subdivision Regulations. Because of its complexity and importance to the character of the city,
this ordinance was reviewed by both the Board and, earlier, by an appointed citizens committee,
in great depth. The revisions proposed by the Board and those proposed by the eazlier committee
reflect a determined effort to eliminate the problem of conflicting provisions and to bring the
language and the intent of the code up-to-date. During this process the Board has taken the
opportunity to address issues unknown or un-addressed at the time of the 1982 adoption date.
The following summary is intended to highlight certain azeas where the Board concentrated its
efforts. This is in no way intended to minimi~$ the time and effort put into the more mundane, but
difficult, task of revising the definitions and eliminating the conflicting language found throughout
the existing code.
The issue of Secondary and Accessory structures was an initial point of concentration.
The definitions and regulations of these two types of uses overlapped significantly. The Board
has made recommendations to correct this. Another major point of interest was the regulation of
Home Occupations. These uses have the potential to seriously disrupt the residential character of
a neighborhood. The Board approached this issue by separating these uses into two classes.
..,Those considered office record keeping type uses are permitted while those with the potential for
adverse impacts are permitted only by Exception. Another issue that has repeatedly come before
the Board over the years has been Exceptions and Variances in the area of Town Center. To
address the different character of this azea the Board has proposed the creation of a Central
Business District zone to encompass that area as well as a portion of Atlantic Boulevard
continuing westward. The subdivision and re-platting regulations were also revised to make them
clear and more logically ordered.
Finally, the Boazd also has addressed the issue of pervious versus impervious surface
coverage limits on both residential and commercial properties. An important element of this effort
remains uncompleted at this time. The establishment of the specific percentage limits still awaits
input from the design of the Core City Utility project. It is the intent of the Boazd to have this
information ava~7able for discussion with the City Commission at a joint workshop meeting
sometime between first and final reading of the ordinance. This issue, along with the many
detailed changes proposed in Ordinance 90-00-169 create a need, in the Boazds collective
opinion, to meet jointly with the City Commission to permit a free exchange of information
between the two bodies. -With this in mind the Board will make itself available for such a meeting
at the request of the City Commission.
