AGENDA TTEM: Request for Use-by-Exception to operate a church at 40 Simmons Road in
the Commercial General district.

BACKGROUND:
May 1, 2000
The applicant owns property at 40 Simmons Road and desires to operate a church within the
existing commercial budding at that location. A portion of the building is currently occupied by a
hair salon business. The remainder of the building wIlI be occupied by the church. No exterior
additions are planned for the building. The applicant owns the adjoining Iot and desires to provide
the required pazking there. He is aware that the seating capacity will be limited by the number of
parking spaces provided.
The existing business must be provided with two parking spaces while it exists, based
upon the requirement of one space per 300 square feet of commercial area. The remaining 15
pazking spaces may be counted toward the seating capacity of the church. This would allow up to
60 persons at any one time. At this time it is not known if the costs of the interior renovations
will trigger the landscape code requiremeirts.
BUDGET: None.
RECOMMENDATION:
After deliberation the Community Development Board recommends approval of this Use-by-
Exception with the following conditions:

2. The maximum seating capacity must strictly meet the number of pazking spaces
provided
2. Two parking spaces shall be reserved for the commercial space at the front of the
building.
3. This Exception be granted to the applicant only and for this location only.
