AGENDA ITEM: Request for Use-by-Exception to operate a Convenience Store with
gasoline sales at 715 Atlantic Boulevard in the Commercial General
district.

BACKGROUND:
The applicant owns the commercial property at the northeast corner of Atlantic Boulevard and
Sailfish Drive. He desires to construct a convenience store with gasoline pumps which requires a
Use-by-Exception approval per Section 24-111(c)(14). That section by reference points to the
CL, Commercial Limited, Use-by-Exception described in Section 24-110(c)(6)Convenience food
store with retad sale of gasoline. The applicant has also requested a rear setback Variance for his
proposed building. All Zoning Code requirements will be met.
This location contained a gasoline service station in the past, but has been vacant for more than
five yeazs. Section 24-165 provides specific site area and geometry requirements for service
stations. Staffhas interpreted this section to include Convenience Stores with retail sales of
gasoline because of the apparent intent of this section to buffer the gasoline pumps from traffic
and adjacent properties for safety reasons. The site meets the dimensional and other requirements
of 24-165.
BUDGET: None.
RECOlbIlVIENDATION:
After thorough deliberation the Communi Development Boazd recommended approval of this
request with the conditions that it be granted to the applicant only and for this location only. The
Board deferred action on the request for Variance. pending additional information. The
disposition of the Variance does not bear upon the issue of this Use-by-Exception.
