AGENDA ITEM: Subdivision Waiver requested by Kevin Bennett to allow new residential
lots with width of less than seventy-five (75) feet at the Building
Restriction Line and less than 7,500 square feet of lot area.

BACKGROUND: The applicant requests a waiver from Section 24-255 (a) of the Subdivision
regulations, which requires all new residential lots to be 75-feet in width and to contain 7500 square
feet of lot area. The subject property is an un-platted tract of land located on the south side of Kestner
Road, west of Main Street. The property is 200-feet in width and 135-feet in depth. This area is zoned
RG-1 (Residential, two-family) but is within the Residential, Low Density land use category. The
Paradise Cove subdivision is located directly across Kestner Road from this property. The Applicant
wishes to divide the property into four 50-foot wide by 135-foot deep lots, and develop each lot with a
single-family residence. Section 24-191 (below) sets forth conditions under which the City
Commission may waive requirements of the Subdivision Regulations.
Sec. 24-191. Waiver.
(a) General. Where the City Commission finds that undue hardship due to unreasonable practical
difficulties may result from strict compliance with this Article, the City Commission may approve a
waiver to the requirements of this Article if the waiver serves the public interest.
(b)Conditions of waiver. An Applicant seeking a waiver shall submit to the City Commission a written
request for the waiver stating the reasons for the waiver and the facts, which support the waiver.
The City Commission shall not approve a waiver unless it determines as follows.
(1) The particular physical conditions, shape or topography of the specific property involved
causes an undue hardship to the Applicant if the strict letter of the Article is carried out.
(2) The granting of the waiver will not be injurious to the other adjacent property.
(3) The conditions, upon which a request for waiver are based, are peculiar to the property for
which the waiver is sought,are not generally applicable to other property and do not result from
actions of the Applicant.
(4) The waiver is consistent with the intent and purpose of this Chapter, the Comprehensive Plan
and the requirements of this Article. If the City Commission approves a waiver, the City
Commission may attach such conditions to the waiver as will ensure that the waiver will
comply with the intent and purpose of this Article.
BUDGET: No budget issues.
RECOMMENDATION: Staff cannot find that the creation of 50-foot wide lots is consistent with the
Residential, Low Density land use designation as established by the Comprehensive Plan or that the
request meets the conditions of Section 24-191.

I have been told by the City of Atlantic Beach that I am permitted to build two
duplexes (four town houses) but not four detached houses. I am seeking approval
for a subdivision waiver. My intention is to divide subject property on Kestner
Road into four (4) 50x134.6 ft. lots..Each lot will have 6,730 square feet. There
would be four single family detached houses in lieu of two duplexes (four town
houses). The individual house concept is in keeping with the recent completion of
the very successful and attractive Paradise Cove.
It seems to construct four units —using exact floor plans as the detached housing-
together with a 16x8 ft. storage connection at the rear of the house would be an
inferior use of land and would certainly have no aesthetic advantage over individual
houses. The town houses would ultimately be divided into 50x134.6 lots when sold
off individually, the same dimensions of the lots if used for detached houses.
I, therefore, respectfully request that members of the City Commission grant my
request to build four detached houses.

The owner of the property,Kevin Bennett,is seeking approval for a subdivision waiver in
order to build four single family detached residences on the property.
The Paradise Cove Homeowners Association supports Mr. Bennett's request to build
single family detached homes. This would be in keeping with the beauty and continuity
of the Paradise Cove neighborhood. The Paradise Cove homeowners have expressed
their concern that townhomes would not only be towering above their properties, but
would detract from the Paradise Cove neighborhood.

(a) Subdivision defined. For the purposes of this Article, Subdivision shall mean the division of Land
into three (3) or more'Lots or Parcels, which may include establishment of new Streets and Alleys,
stormwater facilities, infrastructure including but not limited to water, sewer, and utilities. The term
Subdivision shall also include Replat and the division of previously recorded Subdivisions when three
(3) or more Lots or Parcels are created, and when appropriate to the context, Subdivision also relates
to the process developing Land.
(b) Improvements defined. For the purposes of this Article, Subdivision Improvements may include, but
shall not be limited to street pavements, curbs and gutters, sidewalks, alley pavements, walkway
pavements, water mains, sanitary sewers, lift stations, storm sewers or drains, street names, signs,
street lights, landscaping, Permanent Reference Monuments (PRMs), Permanent Control Points
(PCPs), monuments, or any other Improvement as may be required by the City Commission or these
Land Development Regulations.
Sec. 24-188. Requirements for approval and recording of a Final Subdivision Plat or a Replat.
(a) No Building Permits shall be issued for any Land that has been divided, or any Lot that has been
created, except in compliance with the requirements of Division 2 of this Article and the requirements
of Chapter 177, Part I, Florida Statutes. Approval of a Final Subdivision Plat or a Replat shall be
required when any of the following conditions result from the division of Land.
(1) The division of any Land will create three(3)or more contiguous Lots or Parcels.
(2) The division of Land, or the change to a previously recorded Plat, Platted Lot or Lot of Record,
will alter an access point, other than a private driveway, change a Street as shown on a recorded
Plat, or change any area dedicated for shared public use, recreation, Open Space, Buffering,
Easement or designated preservation area.
Sec. 24-189. Exemptions from the requirement for approval and recording of a Final Subdivision
Plat or Replat.

(a) Building Permits may be issued following divisions of Land without the need for approval of a Final
Subdivision Plat or a Replat only in accordance with each the following provisions.
(1)The division results in no more than two(2)contiguous Lots or Parcels.
(2)The resultant new Lots, comply with the Minimum Lot Area,Width and Depth,and access
requirements of the applicable Zoning District,the Comprehensive Plan and all other applicable
requirements of these Land Development Rdgulations.
(3) The division and the resultant new Lots shall not create any Nonconforming Structures or any
other Nonconforming characteristic.
(4) Approval by the designated Administrative Official of a Certified Si.ttvey depicting the proposed
new lots verifying compliance with the above requirements. Such Certified Survey shall be
submitted to the City and approved prior to recording of a deed for transfer of ownership of
Lands, and shall be recorded as an addendum to the deed. It shall be the responsibility of the
Ordinance Number: 90-03-184 Initial Effective Date: January 01,2002
with amendments through December 08, 2003

Re: Kestner Road—See attached legal description (Property is just south of and
across from Paradise Cove.)
I have been told by the City of Atlantic Beach that I am permitted to build two
duplexes (four town houses) but not four detached houses. I am seeking approval
for a subdivision waiver. My intention is to divide subject property on Kestner
Road into four (4) 50x134.6 ft. lots..Each lot will have 6,730 square feet. There
would be four single family detached houses in lieu of two duplexes (four town
houses). The individual house concept is in keeping with the recent completion of
the very successful and attractive Paradise Cove.
It seems to construct four units—using exact floor plans as the detached housing-
together with a 16x8 ft. storage connection at the rear of the house would be an
inferior use of land and would certainly have no aesthetic advantage over individual
houses. The town houses would ultimately be divided into 50x134.6 lots when sold
off individually, the same dimensions of the lots if used for detached houses.
I, therefore, respectfully request that members of the City Commission grant my
request to build four detached houses.

EXHIBIT A-ORDINANCE NUMBER: 90-03-184
(a) Subdivision defined. For the purposes of this Article, Subdivision shall mean the division of Land
into three (3) or more'Lots or Parcels, which may include establishment of new Streets and Alleys,
stormwater facilities, infrastructure including but not limited to water, sewer, and utilities. The term
Subdivision shall also include Replat and the division of previously recorded Subdivisions when three
(3) or more Lots or Parcels are created, and when appropriate to the context, Subdivision also relates
to the process developing Land.
(b) Improvements defined. For the purposes of this Article, Subdivision Improvements may include, but
shall not be limited to street pavements, curbs and gutters, sidewalks, alley pavements, walkway
pavements, water mains, sanitary sewers, lift stations, storm sewers or drains, street names, signs,
street lights, landscaping, Permanent Reference Monuments (PRMs), Permanent Control Points
(PCPs), monuments, or any other Improvement as niay be required by the City Commission or these
Land Development Regulations.
Sec. 24-188. Requirements for approval and recording of a Final Subdivision Plat or a Replat.
(a) No Building Permits shall be issued for any Land that has been divided, or any Lot that has been
created, except in compliance with the requirements of Division 2 of this Article and the requirements
of Chapter 177, Part I, Florida Statutes. Approval of a Final Subdivision Plat or a Replat shall be
required when any of the following conditions result from the division of Land.
(1) The division of any Land will create three(3)or more contiguous Lots or Parcels.
(2) The division of Land, or the change to a previously recorded Plat, Platted Lot or Lot of Record,
will alter an access point, other than a private driveway, change a Street as shown on a recorded
Plat, or change any area dedicated for shared public use, recreation, Open Space, Buffering,
Easement or designated preservation area.
Sec. 24-189. Exemptions from the requirement for approval and recording of a Final Subdivision
Plat or Replat.
•
(a) Building Permits may be issued following divisions of Land without the need for approval of a Final
Subdivision Plat or a Replat only in accordance with each the following provisions.
(1)The division results in no more than two(2)contiguous Lots or Parcels.
(2)The resultant new Lots,comply with the Minimum Lot Area, Width and Depth,and access
requirements of the applicable Zoning District,the Comprehensive Plan and all other applicable
requirements of these Land Development Rdgulations.
(3) The division and the resultant new Lots shall not create any Nonconforming Structures or any
other Nonconforming characteristic.
(4) Approval by the designated Administrative.Official of a Certified Survey depicting the proposed
new lots verifying compliance with the above requirements. Such Certified Survey shall be
submitted to the City and approved prior to recording of a deed for transfer of ownership of
Lands,and shall be recorded as an addendum to the deed. It shall be the responsibility of the
Ordinance Number: 90-03-184 Initial Effective Date: January 01,2002
with amendments through December 08, 2003

Dear Mr. Bennett:
I write in reply to your attached fax. The regulations you have included with your fax are very
outdated. (Note at the bottom of the page, these regulations are from Supplement No. 6; the
current City Code is at Supplement No. 28.) Even those previous regulations, however,
established the 5000 square foot of lot area and the 50-foot width as minimum requirements.
Those minimum requirements recognize the existing platted lots that historically existed within
certain areas of the City, but the requirement for new lots to contain minimum lot area of 7500
square feet and minimum width 75-feet of has been in place since at least January 26, 1970. I
have enclosed a copy of Section 23-5 (e) of the City's subdivision regulations from Ordinance
47-70-1, which were in effect in 1970. I have also enclosed the current regulations that apply to
new lots.
Your property on Dutton Island Road, West consists of three platted Lots of Record that meet the
current zoning and subdivision regulations as well as the City's Comprehensive Plan. The only
process through which the lot width requirement of the subdivision regulations may be changed
is through a Subdivision Waiver in accordance with Section 24-191, a copy of which I have
enclosed. You certainly have the right to make this request of the City Commission, but I must
be frank in advising it is my opinion, based upon previous actions of the Commission, that your
request would not likely be approved. Please be aware that even if the City Commission were to
approve a waiver allowing four lots to be created, approval of a re-plat would be required. You

Sec. 24-255. Lots.
(a) General. Lot size,width, depth, shape and orientation, and the minimum Building Setback lines shall
be appropriate for the location of the Development and for the type of development and Use
proposed. Lot arrangement and design shall be such that all Lots shall provide satisfactory and
desirable Building sites. Minimum sizes for Lots shall be as set forth within the applicable Zoning
District requirements. Unless expressly provided for within this Chapter, no residential Lot created
after the initial effective date of these Land Development Regulations shall have a width of less than
seventy-five (75) feet at the Building Restriction Line, or shall it contain less than seven thousand,
five hundred(7,500)square feet unless approved as part of a Planned Unit Development.
(b) Dimensions. Lot dimensions shall conform to the requirements of Article III of this Chapter, and the
depth and width of properties reserved or laid out for commercial and industrial purposes shall be
adequate to provide for the off-Street service and parking facilities required by the type of Use and
Development proposed.
(c) Residential Corner Lots. Corner Lots for residential Use shall have extra width, greater than a
corresponding interior Lot, to accommodate the required Building Setbacks from any orientation to
both Streets.
(d) Street access. All Lots shall be provided with satisfactory and permanent access to a paved public
Street. No new Lot shall be created, which prohibits established access or reasonable access to an
Abutting Property.
(e) Double frontage Lots. Creation of new residential Lots having double Street frontage shall be
avoided.
(f) Building Restriction Lines. The Developer shall establish Building Restriction Lines in accordance
with approved Final Subdivision Plat, and such Building Restriction Lines shall be shown on the
recorded Plat.
Sec. 24-256. Provision for required recreation. New Subdivisions containing ten (10) or more acres
shall be required to provide a minimum of one acre dedicated for recreation purposes. A requirement of
one acre per each ten (10) acres, or fractional portion thereof, shall be required for new Subdivisions
exceeding ten (10) acres in size. A minimum of fifty (50) percent of Lands required for recreation shall
contain active recreation facilities such as ball-fields or multi-purpose fields, tennis courts, skateboard
facilities, swimming pools and the like.
Sec. 24-257. Required Monumentation.
(a) Iron pipes. Iron pipes shall be placed at all block corners, angle points and points of curves in Streets,
and at intermediate points as shall be required by the designated Administrative Official.
(b) Permanent Reference Markers. A sufficient number of Permanent Reference Monuments shall be set
in each residential Subdivision, and in no case less than two (2) such monuments and in no case more
than two thousand (2,000) feet apart, either within the tract or on the exterior boundaries thereof, or
both, properly referenced, for both construction and future City use. The Permanent Reference
Monuments shall meet all the specifications set out in Florida Statutes, Chapter 177.091, and as may

(a) Subdivision defined. For the purposes of this Article, Subdivision shall mean the division of Land
into three (3) or more Lots or Parcels, which may include establishment of new Streets and Alleys,
stormwater facilities, infrastructure including but not limited to water, sewer, and utilities. The term
Subdivision shall also include Replat and the division of previously recorded Subdivisions when three
(3) or more Lots or Parcels are created, and when appropriate to the context, Subdivision also relates
to the process developing Land.
(b) Improvements defined. For the purposes of this Article, Subdivision Improvements may include, but
shall not be limited to street pavements, curbs and gutters, sidewalks, alley pavements, walkway
pavements, water mains, sanitary sewers, lift stations, storm sewers or drains, street names, signs,
street lights, landscaping, Permanent Reference Monuments (PRMs), Permanent Control Points
(PCPs), monuments, or any other Improvement as may be required by the City Commission or these
Land Development Regulations.
Sec. 24-188. Requirements for approval and recording of a Final Subdivision Plat or a Replat.
(a) No Building Permits shall be issued for any Land that has been divided, or any Lot that has been
created,except in compliance with the requirements of Division 2 of this Article and the requirements
of Chapter 177, Part I, Florida Statutes. Approval of a Final Subdivision Plat or a Replat shall be
required when any of the following conditions result from the division of Land.
(1) The division of any Land will create three(3)or more contiguous Lots or Parcels.
(2) The division of Land, or the change to a previously recorded Plat, Platted Lot or Lot of Record,
will alter an access point, other than a private driveway, change a Street as shown on a recorded
Plat, or change any area dedicated for shared public use, recreation, Open Space, Buffering,
Easement or designated preservation area.
Sec. 24-189. Exemptions from the requirement for approval and recording of a Final Subdivision
Plat or Replat.
(a) Building Permits may be issued following divisions of Land without the need for approval of a Final
Subdivision Plat or a Replat only in accordance with each the following provisions.
(1)The division results in no more than two(2)contiguous Lots or Parcels.
(2)The resultant new Lots,comply with the Minimum Lot Area, Width and Depth,and access
requirements of the applicable Zoning District,the Comprehensive Plan and all other applicable
requirements of these Land Development Regulations.
(3) The division and the resultant new Lots shall not create any Nonconforming Structures or any
other Nonconforming characteristic.
(4) Approval by the designated Administrative Official of a Certified Survey depicting the proposed
new lots verifying compliance with the above requirements. Such Certified Survey shall be
submitted to the City and approved prior to recording of a deed for transfer of ownership of
Lands, and shall be recorded as an addendum to the deed. It shall be the responsibility of the

application for Building Permits.
(b) Townhouses and residential Dwellings held in Fee-Simple Ownership. Townhouses and Two-family
Dwellings,when divided in ownership, shall not constitute a division of Lands requiring approval of
a Final Subdivision Plat or a Replat,provided that such Dwellings are otherwise in compliance with
these Land Development Regulations and the Comprehensive Plan.
Sec. 24-190. Multiple Lots and Parcels treated as a single Development Parcel.
In the case where more than one Parcel, Platted Lot or Lot of Record has been combined and developed
as a single Development Parcel, such Lots shall not later be developed as a single Lot, unless all
requirements for Development as a single Lot shall be met, including but not limited to Impervious
Surface Area limitations and provision of all Required Yards for all Structures.
Sec. 24-191. Waiver.
(a) General. Where the City Commission finds that undue hardship due to unreasonable practical
difficulties may result from strict compliance with this Article, the City Commission may approve a
waiver to the requirements of this Article if the waiver serves the public interest.
(b) Conditions of waiver. An Applicant seeking a waiver shall submit to the City Commission a written
request for the waiver stating the reasons for the waiver and the facts, which support the waiver. The
City Commission shall not approve a waiver unless it determines as follows.
(1) The particular physical conditions, shape or topography of the specific property involved causes
an undue hardship to the Applicant if the strict letter of the Article is carried out.
(2) The granting of the waiver will not be injurious to the other adjacent property.
(3) The conditions, upon which a request for waiver are based, are peculiar to the property for which
the waiver is sought, are not generally applicable to other property and do not result from actions
of the Applicant.
(4) The waiver is consistent with the intent and purpose of this Chapter,the Comprehensive Plan and
the requirements of this Article. If the City Commission approves a waiver,the City Commission
may attach such conditions to the waiver as will ensure that the waiver will comply with the
intent and purpose of this Article.
Sec. 24-192. Vacation of Previously Recorded Subdivision Plats.
An Applicant may apply for the vacation of a recorded Plat, or a portion of a Plat by written application to
which a copy of the Plat shall be attached requesting the same to be vacated. Vacation of Plats shall
require approval by resolution of the City Commission, and such vacation shall be approved only in
accordance with Chapter 177.101, Florida Statutes.

AN ORDINANCE ADOPTING A REVISION AND CODIFICA-
TION OF THE ORDINANCES OF THE CITY OF ATLANTIC
BEACH, ENTITLED "THE CODE OF THE CITY OF
ATLANTIC BEACH, FLORIDA, '' PROVIDING FOR THE
REPEAL OF CERTAIN ORDINANCES NOT INCLUDED
THEREIN, WITH CERTAIN EXCEPTIONS, AND FOR
OTHER PURPOSES HEREINAFTER SET OUT.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA:
SECTION 1. There is hereby adopted by the City Commission that certain
Code entitled "The Code of the City of Atlantic Beach, Florida, " containing certain
ordinances of a general and permanent nature as compiled, consolidated, codified
and indexed in Chapters 1 to 28, both inclusive, of which Code at least one copy has
been and is now filed in the office of the City Clerk, and shall there remain for pub-
lic use and inspection.
SECTION 2. The provisions of such Code shall be in force on and after January
27, 1970, and all ordinances of a general and permanent nature adopted on final
reading and passage on or before August 1, 1969, and not contained in such Code are

hereby repealed from and after January 27, 1970, except as hereinafter provided.
SECTION 3. The repeal provided for in the preceding section of this ordinance
shall not affect any offense or act committed or done or any penalty or forfeiture in-
curred or any contract or right established or accruing before January 27, 1970;
nor shall it affect any prosecution, suit or proceeding pending or any judgment ren-
dered prior to January 27, 1970; nor shall such repeal affect any ordinance or reso-
lution promising or guaranteeing payment of money for the City or authorizing the
issue of any bonds of the City or any evidence of the City's indebtedness or any con-
tract or obligation assumed by the City; nor shall it affect any annual tax levy, appro-
priation or budget; nor shall it affect any right or franchise conferred by ordinance
or resolution of the City Commission on any person or corporation; nor shall it affect
any ordinance adopted for purposes which have been consummated; nor shall it affect
any ordinance which is temporary, although general in effect, or special, although
permanent in effect; nor shall it affect any ordinance relating to the salaries of the
City officers or employees; nor shall it affect any ordinance annexing territory to
the City; nor shall it affect any ordinance naming, renaming, opening, accepting or
vacating streets or alleys in the City; nor shall it affect any ordinance amending the
zoning map; nor shall it affect any ordinance adopted on final reading and passage
after August 1, 1969,
SECTION 4. Whenever in the Code adopted by this ordinance or in any other
ordinance or resolution of the City or in any rule, regulation or order promulgated by
any officer or agency of the City under authority duly vested in him or it any act is

the doing of any act is required or the failure to do any act is declared to be unlawful

violation of any such provision of such Code or any other ordinance or resolution of

other ordinance or resolution of the City or such rule, regulation or order shall

(d) Blocks.
(1) No block shall be longer than twelve hundred feet.
(2) There may be established one or more courts, dead-end streets or other
arrangements; provided, that proper access shall be given to all lots from a dedicated
street or court. A dead-end street shall terminate in a cul-de-sac having a minimum
radius of fifty feet. A dead-end street shall not exceed one thousand feet in length.
(e) Lots.
(1) The lot arrangement and design shall be such that all lots will provide
satisfactory and desirable building sites, properly related to topography and the char-
acter of surrounding development.
(2) Al]. side lines of lots shall be at right angles to straight street lines and
radial to curved street lines. Lots running from street to street shall not be permit-
ted.
(3) No lot shall have a width of less than seventy-five feet at the building line,
nor shall it contain less than seven thousand five hundred square feet.

(4) The corner lots shall have extra width sufficient to permit the establish-
ment of front building lines on both the front and side of the lots adjoining the streets.
(f) Building lines. The subdivider shall establish building lines in accordance
with the needs of each development, but in no case shall such building lines be less
than twenty-five feet from the right of way of the street or highway upon which resi-
dential lots front. Such building lines shall be shown on the plat.
(g) Parks, school sites, etc. In subdividing property, consideration shall be
given to suitable sites for schools, parks, playgrounds and other common area for
public use so as to conform to any recommendations of the currently effective city
plan. Such areas shall be indicated on the preliminary plan. z`
(h) Easements along streams or canals. Whenever any stream or important
surface drainage course is located in an area which is being subdivided, the sub- a;
divider shall dedicate an adequate easement along each,side of the stream or thru
lakes or lagoons for the purpose of widening, deepening, sloping, improving or pro-
tecting the stream for drainage, parkway or recreational use. (Ord. No, 67-58-1,
