Dear Ms. Martin:
The City of Atlantic Beach has been duly informed of the proposed conversion of the
above referenced property from rental apartments to a condominium form of ownership.
The City of Atlantic Beach has no regulation addressing or prohibiting conversion to
condominiums. Such a conversion would of course be subject to all Statutory laws and
provisions addressing the formation of a condominium form of ownership, as well as any
applicable Florida Building Codes.
The subject propertyexists as an occupied, legal multi-family residential use consistent
with the Residential General, Multi-family (RG-2) Zoning District. This residential use
may continue in the form of rental apartments or residential condominium units. As of
this date, the City is not aware of any facts with respect to this property, which would
constitute a violation of any zoning or Land Development Regulations.

Our law firm represents developer LM Realty Investments,LLC (Michael McCann) in preparing the
condominium documents for Beachside Condominiums,which condominium is being created by
conversion of the Poinsettia Street Apartments. Our file contains previous correspondence between you
and Mike McCann regarding a vesting determination. Because you are familiar with the project, I wanted to
contact you regarding a letter of zoning compliance which is required as a part of the condominium
documents by the Condominium Act. The letter must state that the city has been notified of the conversion
and that the conversion complies with all applicable zoning requirements. Please let me know if you are the
proper person to whom to direct my inquiry, and if not, to whom I should direct this inquiry.
The RE# for this property is 170642 0100 and the legal description is "Saltair Subdivision, Section 3,Lots
