I have reviewed the information you sent along with your e-mail. This parcel is considered to be a Lot
of Record (per definition paragraph (b) below) in that it was created in its current configuration in 1953.
(I would note that if divided in this manner today, such a division would not fully comply with City
Land Development Regulations and would not be considered a Lot of Record.)
Mr. Ahern is correct with respect to platted Building Restriction Lines (BRLs). Future Development is
also subject to any BRLs shown on the plat, which appear just to be to 30' BRL along the front of the
lot. The rear yard (west) zoning setback is 20-feet, and side yard setbacks are 7.5-feet.
Lot of Record shall mean:
(a) a Lot that is part of a documented Subdivision,the map of which has been recorded in the Office of the Clerk
of the Circuit Court, or
(b) a Lot or parcel of Land described by metes and bounds,the description of which has been recorded in the
Office of the Clerk of the Circuit Court, consistent with and in compliance with Land Development Regulations
in effect at the time of said recording.
This parcel is Zoned RS-L (Residential, Single-family Large-Lot.)
(d) Minimum Lot Size. The minimum size for Lots within the RS-L Zoning Districts shall be as
follows.
(1) Minimum Lot or site area: Ten Thousand (10, 000) square feet.
(2) Minimum Lot width: One hundred (100) feet.
(3) Minimum Lot depth: One hundred (100) feet.
Existing legally established Lots of Record may exist, which do not meet the above Lot width,
depth or area requirements. These Lots may be developed subject to all applicable Land
Development Regulations; however, all Lots created after the effective date of Ordinance 90-06-
189, shall comply with the Minimum Lot Size requirements in order to obtain Building Permits
authorizing Development.
(e) Minimum Yard Requirements. The minimum Yard Requirements in the RS-L Zoning Districts shall
be as follows.
(1) Front Yard: Twenty (20) feet.
(2) Rear Yard: Twenty (20) feet.
(3) Side Yard: Seven and one-half(7.5) feet.
(f) Building Restrictions. Additional Building restrictions within the RS-L Zoning Districts shall be as
follows.
(1) Maximum Impervious Surface: Fifty (50) percent.
(2) Maximum Building Height: Thirty-five (35) feet.

Thank you for your reply concerning the property we wish to purchase (Selva Marina Unit No1, Lot 38,
Part of Lot 39). This lot was not listed with a real estate agent but was a for sale by owner, and so we
have contacted an attorney, Fred Ahern, to provide us with a copy of the applicable Deed Restrictions.
Also, we asked him to determine whether Lot 39 had been previously divided.
He informed us that the recorded plat states that we have a 30 ft. front building restriction line and that
Lot 39 was previously divided in 1953.
Mr. Ahern did ask us to confirm with you that the city will use the southerly boundary line of the portion
of Lot 39 to determine the distance of the southerly side setback line of the property.
Thank you once again for your help in this matter. I am forwarding Mr. Ahern's letter to you as an
attachment.

Dear Bill:
I have been able to confirm that the covenants and restrictions for your Lot expired in
1980. Therefore, there are no setback lines per covenants and restrictions. Accordingly your
rear and side setback lines will be per the City of Atlantic Beach's zoning ordinances. The
recorded plat reflects that there is a 30 ft. front building restriction line. If the platted 30 ft. front
building restriction line is more restrictive than Atlantic Beach's zoning ordinances, you will
have to comply with the platted 30 ft. front setback. The platted 30 ft. front setback is not
reflected on the existing survey (copy attached) but the subject property is still subject to it.
The portion of Lot 39 that is being conveyed with Lot 38 was originally separated from
Lot 39 in December 1953, by a deed recorded in Deed Book 1647, Page 169 (a copy of which is
attached). Since this deed separated Lot 39 in 1953, I believe that the portion of Lot 39 that is
being purchased should be considered by the City to be "legal subdividing" with Sonya Doerr.
Also, confirm with Ms Doerr that the City will use the southerly boundary line of the portion of
Lot 39 that you are buying to determine the distance of the southerly side setback line of your
property.
