You have requested that this development project be vested from compliance with the fifty (50) percent Maximum Impervious Surface limit for residential development, which was adopted by City of Atlantic Beach Ordinance Number 90-01-172 on November 26, 2001, and which became effective on January 01, 2002. Based upon the information you have submitted, approximately $50,000.00 of expenses were incurred prior to January 01, 2002. These fees include surveying and permitting fees, architectural and engineering fees, land clearing and demolition costs. The City of Atlantic Beach finds that this project had commenced in good faith reliance on the previous regulations to the extent that significant expenses were incurred prior to the effective date of the new impervious surface regulations. Accordingly, this project shall be vested to the extent of impervious surface as depicted within construction and engineering plans submitted with your application for a building permit on February 02, 2002. Please bear in mind that this finding applies only to construction as proposed within these plans, and is limited only to the impervious surface limitation. All construction and any future increase to impervious surface shall otherwise be subject to all applicable land development regulations. While this project is determined to be vested from the fifty percent impervious surface limit, please provide impervious surface calculations for this proposed development. The project will be vested to develop that amount of impervious area, rather than wholly exempt from any impervious limitation. This calculation is required prior to the issuance of Building Permits, and your surveyor or builder should be able to provide this information.
