I know Lynda is waiting to hear a response, but I told her I needed to get with you. I can't see how he has any vested right to build a duplex on this property just because there are other duplexes in the area. It is in Low Density, Residential, which requires 14,500 square feet of lot area for a new duplex. He just bought this property in October of last year, and the 14,500 square feet lot size requirement has been in Chapter 24 since 11/26/01. There is reference to conversations with "Jenny Schuler" in the letter. I assume he means Jennifer Schlueter, who if you recall used to be the Building Permits Clerk. I cannot imagine she would have ever told anyone they could do a duplex anywhere. She always deferred such questions to me if she had questions at all, and besides, she new this issue pretty well. We have had a hand-out we give to everyone with required lot sizes for as long as I have been here. I don't have any problem with him doing a duplex, except that he is about 30% short of needed lot size. What is your suggestion as to how to respond? The property is located between Dutton Island Road West and Dudley Street. This parcel is shown on the Plat of"Donner's Replat" as Parcel 7 of Block 1, but this parcel is excluded from the plat and not platted. An old existing drainage ditch that runs from Dutton Island Road West to Dudley Street physically separates Parcel 7 into two parcels. Mr. Mabry acquired Parcel 7 in 1989 and sold the easterly half of the parcel (appx. 119' x 210') including most of the drainage ditch on October 17, 2001. This letter concerns the westerly half. On May 6, 2004, Mr. Mabry surveyed the westerly portion of Parcel 7 into a northern lot (appx. 103' x 100') and southern lot (appx. 85' x 109'). Because the surrounding neighborhood is primarily comprised of duplex dwellings, Mr. Mabry and his former wife, Marie Mabry, both planned on constructing a duplex on their parcels. This was discussed with Jenny Schuler who was an employee of the City at the time that the properties were divided and the survey was made. Ms. Schuler recalls Mr. Mabry submitting his survey and discussions with her regarding construction of the duplexes and obtaining a tree survey. On October 6, 2005, in reliance upon his discussions with the City, Steve Mabry deeded the northern parcel to Marie Mabry (O.R. Book 12818, page 1452) and retained the southern parcel. Mr. Mabry's parcel contains 9,938 gross square feet; Marie Mabry's parcel contains approximately 10,300 gsf. The two parcels are consistent with nearby lands that are generally divided into 50' x 100' lots. Recently, Mr. Mabry was stunned to hear that, notwithstanding his prior discussions with the City concerning duplex development on his property, the City's current regulations prohibit the use of the Mabry lots for duplexes because the lots are each less than 14,500 gsf in size. Enclosed is a copy of a tax panel map. As you can see, most of the lots in this area are small 5,000 gsf lots but a majority of the homes constructed on these lots are duplexes or townhomes. The Jacksonville Housing Authority owns a duplex on approximately 5,250 gsf adjacent to Mr. Mabry's parcel and there are eight (8) other duplexes on Dudley Street, all located on lots that are approximately 5,000 gsf. Because most of the lots in the area are existing and improved, the Mabry's are virtually the only owners in this area that are adversely affected Community Development Department, City of Atlantic Beach • May 12,2006 ' Page 2 by this regulation. In essence, the City is "spot zoning" this property by prohibiting him from improving his property with a duplex in an area where duplexes are a predominant housing type. Sorry I have not a had a chance to get with you on Steve Mabry's property. Had to go out of town unexpectedly this week, but will try to get it on Tuesday. Have a couple of thoughts I need to talk with Alan Jensen about. The difficulty with this one is that there have been no zoning or Comp Plan changes in this area for decades. FLUM designation has been Low Density, Residential (1-6 du/pa) since Plan adoption in 1990, and it has always been zoned RG-1, which is a two-family or single-family zoning district subject to density limits per Comp Plan. Many of the existing duplexes in that area are old, and developed pre-Comp Plan. (Not all of them, though.) I suggested during our EAR-based Comp Plan amendments a couple of years ago that maybe this area should be changed to Medium Density to "match"the development and platted lot pattern, but that idea fell flat, and the trend in the entire western part of Atlantic Beach has moved more towards single-family. The Lot Size requirements to implement the Comp Plan density, were expressely added to the Land Development Regulations in 2001. (1)Lot Size in the RG-1 and RG-1A Zoning Districts: i.
