Exh 8ESE June 12, 2000 STAFF REPORT CITY OF ATLANTIC BEACH CITY STAFF REPORT AGENDA ITEM DATE: SUBMITTED BY: BACKGROUND ~"~""11 Interlocal Agreement with the City of Jacksonville for the Distritribution of proceeds from the '/2 cent surtax June 6, 2000 Jim Hanson, Ci Mayor John Delaney has roposed that a referendum be held in Duval County on Sept. 5, 2000 on the question of imposing anadditional %z cent sales surtax to fund "The Better Jacksonville Plan". Mayor Delaney has also proposed that the Cities in Duval County get 50% of the sales tax proceeds on a per capita basis. While many of the projects listed in The Better Jacksonville Plan benefit all citizens in Duval County, there are also many projects that are of specific benefit only to citizens to the City of Jacksonville .It is therefore appropriate for the Beaches Cities and Baldwin to receive a portion of the sales tax proceeds to use on projects that directly benefit their citizens. The City of Jacksonville has drafted the proposed agreement for distribution of the proceeds from the '/z cent sales surtax if approved by the voters, and that agreement has been reviewed and approved by our City Attorney. The Interlocal Agreement references a proposed City of Jacksonville ordinance (2000-572E) which specifies uses that can be made of the funds. These include the following * "Like Purposes" to those listed in the Jacksonville Ordinance which includes the following: Roads/Transportation Environment/Quality of Life Economic Development ~'"'1 Public Facilities * Bond Indebtedness for new projects ., ,, 8E June 12, 2000 The proposed 1/2 cent sales surtax will continue for 30 years unless ended by the City of Jacksonville beforehand. BUDGET: An additional'/2 cent sales tax would have brought in revenues in Duval County in 1999 of approximately $53,307,000. Atlantic Beach's share of the proceeds as described in this Interlocal Agreement would amount to approximately 462,000 per year. RECOMMENDATION: (1) The Mayor and Commission authorize execution of the Interlocal Agreement with the City of Jacksonville for distribution of proceeds of the '/2 cent sales surtax (2) If the sales tax referendum is approved by the voters in September that the Mayor and Commission should consider use of the proceeds in Atlantic Beach on a yearly basis at the time of the Budget Adoption Process and in consideration of ' the City's Strategic Goals. The City's current Strategic Goals will require considerably more than $462,000.to implement. The top needs of Atlantic Beach will. no doubt change over the next 30 years. The City Commission needs to reprioritize the most urgently needed projects every one to two years in the future to account for accomplishments of previous goals as well as new issues that may come up and the refocusing of priorities. The cities of Atlantic Beach, )acksonviUe Beach and Neptune Beach, pursuant to Section 212.055(2}(c), Florida Statutes, are entitled to a distribution of'1'he Better Jacksonville 'la Cent Sales Tax proceeds either by interlocal agreement or by statutory formula. Because The Better Jacksonville Plan will ax least partially benefit the residents of Atlantic Beach, Jacksonville Beach and Neptune Beach, the cities ofAtlantic Beach, JacksonvilIeBeach and NeptuneBeach hereby agree that any distribution to each of those respective muniapalities shall equal fifty percent (50%) of the distnbution amount each of those respective municipalities would otherwise receive, in the absence of an interIocal agreement, pursuant to Sections 212.U55(Zj(c) and 218.b2, p'Iorida Statutes. This distribution to Atlantic Beach, Jacksonville Beach and Neptune Beach shall be used for like purposes as are more particularly descn'bed in Sections 761.102 and 761.106(b}, Jackso3°rvidle Ordinance Code, as enacted by Jacksonville Ordinance 20x0-572-E, and as allowed by law. The balance of said distribution that AtlantieBeach, Jacksonville Beach and NeptuneBeach would receive, in the absence of an interIocaI agreement, shall be distributed to Jacksonville £or deposit in The Better Jacksonville Trust Fund to be used as funding for The Better Jacksonville Plan. 3. This Agreetent is contingent upon both of the following events: (i) Jacksonville 4rdinanee 2000.572 becoming effective; .and (ii) the electorate in the General Services District, of Jacksonville, approving the levy of The Better Jacksonville 112 Cent Sales Surtax. Upon the happening ofboth such events, this Agreement shalIbscorne effective on January 1, 2001, and shall -2- gE June 12, 2000 remain in effect until December 31, 2031, or until The Setter jacksonvilIe 1/2 Cent Sales Surtax is otherwise terminated, pursuant to Jacksonville Ordinance Code, Section 761.106(d), whichever occurs first. Furthermore, as to Jacksonville, the Mayor's authority to execute this Agreement is comingent upon City Council approval of Jacksonville Ordinance 2000-572. 4. Tt is agreed that the goal of the parties hereto is to ensure termination of The Better Jacksonville'/~ Cent Sales Surtax at a date earlier than December 31, 2031. 5. Upon execution of this Agreement and a referendum approving The Better 7acksoaville'/z Cent Sales Surtax, Jacksonville shall notify the FloridaDepartment ofRevenue ofthis Agreement, pursuant to statutory timelines when Jacksonville must notify said iaepartment of such referendum approval. _ 6. Prior to its effectiveness, this Agreement shaII be filed with the Clerk of the Circuit Court, in and for Auval County, Florida, by the Office of General Counsel of the City of7acksonville, as required by Section 163.01(1 ] }, Florida Statutes. 7. This Agreement represents the entire agreement among the parties hereto for the distribution of funds under Section 212.055(2)(c}, Florida Statutes. No statement, representation, writing, or agreement made by any party or any party's representative, which are nat expressed herein shall be binding. The proceeds of 9 the Better Jacksonville 1/2 Cent Sales Surtax shall be remitted to 10 the City, in its capacity as a county and/or its capacity as a 11 city, as provided by law, and shall be distributed, pursuant to 12 Section 212.055(2)(c), Florida Statutes and other applicable 13 provisions of law: (1) among the City of Jacksonville, and any and 14 all municipalities in L?uval County by interlocal agreement, or (2) 15 according to the formula provided in Section 218.62, Florida 16 Statutes. The City's portion of such proceeds shall be deposited 17 by the City in a separate trust fund which is hexeby established 18 and entitled "The Better Jacksonville Trust Fund", -the moneys in 19 which shall be expended as provided by law and this Chapter. Section 3. Referendtua. ta} A referendum of the qualified electors residing in Duval County, Florida is hereby called to be held on September S, 200D, to determine whether or not the imposition of the getter Jacksonville Z/2 Cent Sales Surtax as described herein shall be approved by such qualified electors. (b) The referendum shall be held and conducted in the ms.nner prescribed by Iaw for holding elections under a referendum provision. {c} Ali qualified electors in Duval County shall be entitled and permitted to vote in the referendum. The places of voting shall be thgse polling glares established for voting in other i elections in Duval County. The inspectors and Clerks for the referendum shall be designated by the Supervisor of Elections in accordance with applicable State law. The polls will be open at the polling places from 7:00 A~.M. until 7:00 P.M. on the day herein specified.
