Dear Ms. Cornelius:
The proposed division of your lot does not meet the requirements of Section 24-189 of the Land
Development Regulations. In order for a division of the existing lot to be approved pursuant to
this Section, no more than two parcels may be created; each new parcel must be a minimum of 75-
feet in width at the Building Restriction Line; a minimum of 100-feet in depth at all portions of the
lot, and must contain at least 7500 Square feet of lot area. Further, development of the new lots
must be capable of meeting all required setbacks, any platted Building Restriction Lines, and no
non-conforming lots or features may be created by the division.
The division, as you have depicted in the attached survey creates three lots, with the northern most
residual parcel left as a non-conforming parcel with respect to size, width and depth. As I have
advised, Staff has no administrative authority to approve such a lot division. You may apply to the
City Commission for a Subdivision Waiver, but I must advise frankly, that such a waiver from the
Subdivision regulations is very unlikely to be approved. Please feel free to call me at 247-5826

Dear Ms. Cornelius:
The division of the above-referenced property into two parcels is hereby approved in accordance
with the provisions of Section 24-189 of the City Land Development Regulations. Each new parcel,
as depicted on the attached surveys, and described as the South 75 feet of Lot 1 (the Southerly
portion of platted Lot 1) and Lot 1 except for the South 75 feet (the Northerly portion of platted Lot
1) complies with the 75 foot required lot width and exceeds the required size of 7,500 square feet
of lot area. The approved survey must be recorded as an addendum to the deed, and the future
property owner(s) will be required to submit a copy of this approved survey along with any
application for a building permit.
Please be mindful of two important issues that would apply any future development upon the
proposed new lots: (1) the existing residence would have to be demolished so that no non-
conforming structures are created on either of the two new lots; and (2) Unit No. 2 of the Selva
Marina subdivision contains platted building restrictions lines, as shown on the approved surveys,
which are greater than the required building setbacks. Future developments would be subject to
those platted building restriction lines.
