The invocation, offered by Commissioner Mitchelson,' was followed by the Pledge to the Flag 1. Courtesy of Floor to Visitors: Alan Potter 374 2na Street, referred to "No Trespassing" signs which had been installed recently at Buccaneer sewer plant. Julie Sleeper, 700 Beach Avenue, suggested that the City Commission take a cue from Mayor John Delaney and lower taxes in Atlantic Beach. Don Phillips, 1566 Park Terrace West, complimented the City on the web page. He suggested inserting links with the City of Jacksonville; also suggested that public notices of meetings be placed on the web page, and also include information regarding what a nice place Atlantic Beach is to live. J.P. Marchioli, 414 Sherry Drive, referred to Item #7B - (the ordinance providing that parking signs may be painted on the curb) and said he hoped the city would not impound vehicles without first issuing tickets. Mr. Marchioli also. said he felt the City Commission should require a motion and a second to declare an emergency before waiving the formal bidding procedures. Donald 1VtcDowell, Property Manager of2400 Seminole Road, with report relative to landscaping at the north end of _ Seminole Road Donald McDowell was not in attendance to report on the proposed landscaping at the north end of Seminole Road. The City Manager reported the City Commission had previously approved landscaping plans for this property owner and Mr. McDowell now wishes to landscape the public right-of--way at the north end of Seminole Road, which is in Jacksonville. He indicated that Mr. McDowell's plan has been approved by the City of Jacksonville, and also reported that the property owner would be responsible for the maintenance of the new landscaping. B. Nicole L. Gwyn, Immortal Body in Ink This item was withdrawn at the request of Ms. Gwyn who has requested that this matter be included in the agenda for the meeting on July 24,2000. 3. Unfinished Business from Previous Meeting A, Follow-up report from the meeting of June 26, 2000 (City Manager) The City Manager presented a written report responding to questions which had been raised at the previous meeting. His report is attached as Ezhibit A. With regard to the "No Trespassing" signs at the Buccaneer wastewater treatment plant, the City Manager said it had come to his attention that members of the public had visited. the construction site, and in some occasions had climbed on equipment, and the signs were placed there for the protection of both the citizens and the city. Mr. Hanson reported the sound enclosures for the Buccaneer plant had been ordered at a cost of $31,600 and said that the vendor of the enclosures guaranteed a 22 decibel reduction. The City Manager reported that Aikenhead and Odom would present their final recommendations for the core city drainage project at the Commission meeting of July 24, 2000. Since the chairman of the Stormwater Review Committee (SRC) was out of town, the presentation would be made to the `'" SRC at a later time. M S O E T C I O O N N D Y E S The City Manager reported that the JTA had submitted amended plans for the retention pond at the Mayport Road flyover project and indicated that many of the large oak trees would now be saved. He displayed a plan of Minutes Page 3 July 10,2000 the new configuration of the pond and said one of the sand walkways in - _ Tideviews Preserve would have to be relocated, but it was hoped that an attractive walkway could. be constructed azound the pond: He commended the Tree Boazd for working with. JTA to save the trees.. 4. Consent Agenda: ALL MATTERS LISTED UNDER THE CONSENT AGENDA ARE CONSIDERED TO BE ROUTINE BY THE CITY COMMIS SIGN AND.. WH,L BE ENACTED BY ONE MOTION IN THE FORM LISTED BELOW. THERE WILL BE NO SEPARATE DISCUS SIGN OF THESE ITEMS. IF DISCUSSION IS DESIRED, THAT ITEM WILL BE REMOVED FROM THE CONSENT AGENDA AND .WILL. BE CONSIDERED SEPARATELY. SUPPORTING DOCUMENTATION AND STAFF RECOMMENDATIONS HAVE BEEN PREVIOUSLY SUBMITTED TO THE CITY COMMISSION ON THESE ITEM A. Acknowledge receipt of monthly reports from Building, Occupational License, Public works, and Recreation Departments B. Authorize the Mayor to sign the close-out documents in the ' Law Enforcement Block Grant for the Pursuit Termination Project C. Award contract to Richard Thomas, Inc. in the amount of $34,757.00 for painting at Atlantic Beach wastewater treatment plant pursuant to the specifications of Bid No. 9900- 17,with the exception of Item Nos. 12 and 13 D. Authorize replacement of emergency generator at Lift Station D by Ring Power, Inc., at a cost of $30,023, using JEA Contract Purchase Agreement #11012 (City Manager) Mation: Approve Consent Agenda Items A, B, C, and D as read The motion carried unanimously. 5. He opened the floor for a public hearing and invited comments from the audience. Julie Sleeper, 700 Beach Avenue, inquired as to the purpose of the ordinance. Human Resource Director George Foster, explained that since the City contracted with Jacksonville for fire services, the ordinance had to be amended to reflect this change. Also, this ordinance will provide for separate pension plans for police employees and general employees as mandated by the State of Florida. Since no one else wished to speak for or against the ordinance, the Mayor Pro Tem declared the public hearing closed. Motion: Adopt ordinance No. 58-99-26 There was na further discussion and the motion carried unanimously. B. Ordinance No. 75-00-14 -Public Hearing and Final Reading. AN ORDINANCE OF THE CITY. OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 21, TRAFFIC AND MOTOR VEHICLES, ARTICLE II, STOPPING, STANDING AND PARKING, DIVISION 1, GENERALLY, SEC. 21-19, COMPLIANCE WITH SIGNS PROHIBITING PARKING REQUIRED, AND SEC. 21-25, REMOVING AND IMPOUNDING, TO ADD LANGUAGE TO INCLUDE OFFICIAL MARKINGS ON A CURB, AND PROVIDING AN EFFECTIVE DATE (Commissioner Waters) Mayor Pro Tem Beaver presented Ordinance No. 75-00-14 in full, in writing, and read the ordinance by title only. He opened the floor for a public hearing and invited comments from the audience. Julie Sleeper asked if all old and faded signs would be replaced and was advised that this matter would be taken up with the City Manager. First Reading AN ORDINANCE AMENDING THE ...CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH, AMENDING CHAPTER 20, TAXATION, ARTICLE III, OCCUPATIONAL LICENSE TAX, SEC. 20-59, SCHEDULE OF FEES; AND PROVIDING AN EFFECTIVE DATE Mayor Pro Tem Beaver presented Ordinance No. 45-00-14 in full, in writing, and read the ordinance by title only. Motion: Pass Ordinance No. 45-00-14 on first reading as read Amendment: Increase license fees for "Passenger Vessel through Teen Club" by 5% (which had not been done by staff and approve Ordinance No. 45-00-14 (as amended) on first reading... There was no further discussion and the motion carried unanimously. D. Ordinance No. 95-00-75 -Introduction and First Reading AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, VACATING AND ABANDONING PLATTED EASEMENTS ON LOTS. 8 AND 9, BLOCK 1, OCEAN GROVE, UNIT NO.1, AS RECORDED IN PLAT BOOK 15, PAGE 82 OF THE CURRENT PUBLIC RECORDS OF DUVAL COUNTY, FLORIDA, AND PROVIDING AN EFFECTIVE DATE. Mayor Pro Tem Beaver presented Ordinance No. 95-00-75 in full, in writing, and read the ordinance by title only. Community Development Director George Worley explained the subdivision was adopted by the City of Jacksonville several of years ago. At that time the developer platted a number of utility easements. Utilities were never installed in those easements and the .area was .subsequently annexed into Atlantic Beach. Utility lines have now been located in the street right-of--way and the easements which run through these lots and sometimes underneath structures, are no longer needed by the City. However, the title to the property is clouded because of these easements and the property owner has requested that the City abandon the easements so he can sell the property. Approve property swap between Beaches Habitat and the City and authorize execution of Special Warranty Deed Using a map to illustrate the property in question, George Worley explained the circumstances of the land exchange. Mr. Worley's staff report and map are attached hereto as Exhibit B. Set the tentative millage for FY 2000/2001; set date, time and place for the first public hearing for the purpose of adopting a tentative millage rate and a proposed budget (7:15 p.m. September 11, 2000 in Commission Chambers); and authorize the City Manager to submit form DR-420 to the Duval County Property Appraiser Motion: Adopt current rate as tentative millage rate and set date and time as read and authorize City Manager to submit DR 420 The City Manager said that based on the preliminary budgets submitted by staff, he did not see any reason to increase taxes and was therefore recommending that the millage rate be set the same as last year. He explained the rate could be reduced later if the City Commission so desired, but it could not be increased. The mo#ion carried unanimously. 9. City Manager Reports: A. Quarterly report on Strategic Planning recommendations The City Manager presented a written quarterly status report on the implementation of the City Commission goals as established in their strategic planning session held earlier in the year. A copy of the report is attached as Exhibit C. A copy of his report is attached as Exhibit D. 10. Reports and/or requests from City Commissioners and City Attorney Commissioner Borno: • said he liked the new paving on Seminole Road and wanted to make sure that the blue hydrant markers are replaced • reported that the first two sea turtle nests were due to hatch in the next fourteen days. He reported that 39 sea turtle nests had been found this year between Jacksonville Beach and the Navy base • inquired regarding a recent letter from Duval County Federal Shore Protection regarding beach renourishment. Commissioner Mitchelson said he was following up on this matter and reported that Kevin Bodge, who is involved in many of the Army Corps of Engineers projects, had volunteered his services in monitoring this project. Commissioner Mitchelson He also said he planned to attend the next Beaches and Shores Renourishment Conference in September. Discussion ensued regarding the possibility that the sand may be trucked from the Bount Island area. It was the consensus of the City Commission that this would be very damaging to the streets and they would prefer that the sand be pumped. It was agreed that the City should closely monitor future renourishment projects. Mayor Pro Tem Beaver: • reported he had written to Mayor Delaney recommending that he consider using Mr. Bodge as a resource regarding beach renourishment projects. He suggested the City Manager write to the appropriate person in the City of Jacksonville and request that Atlantic Beach be kept informed regarding proposed beach renourishment projects. • reminded Commissioners of the zoning workshop on July 24, prior to the regularly scheduled Commission meeting Commissioner Mitchelson: • inquired regarding the progress of the grant writers which had been hired by the City. Director Thompson reported that the consultant would submit a draft for a strategic plan on Friday (July 14) • inquired how the city would follow up on the problems on private property which had been revealed by the smoke testing.
