Per Section 23-22(b) of the Municipal Code of Ordinances, any existing developed property upon which there is minor development activity (defined as any new construction, exterior additions, renovations or upgrades that are valued at less than $10,000.00 and/or do not require Atlantic Beach permits) shall be exempt from the requirement for a tree removal permit and mitigation, provided City-wide minimum tree standards are still met. However, should such development activity exceed $10,000.00 and require permits from the City of Atlantic Beach, it becomes major development activity. Should such major development occur within six (6) months subsequent to tree removal, an after -the -fact tree permit and mitigation shall be required. On February 12, 2010, the City received a report of tree removal from the property located at 374 I" Street. Evidence of removal of three (3) or more trees was noted, though there was no apparent development activity on the property, and there were no active permit applications on file with the City at that time. Subsequently, three permits have been issued for the property at 374 1" Street, and their combined values exceed the $10,000.00 threshold: WIND 10-00000282 RAAR 10-00000283 ROOF 10-00000371 Window Replacement Porch Addition, Interior Remodel Roof Repair/Replacement Issued 3/30/2010 Issued 3/30/2010 Issued 3/31/2010 Value = $3,000.00 Value = $14,000.00 Value = $7,300.00 Thus, an after -the -fact tree removal permit is now required for those trees removed from the subject property in early February. A copy of the application packet has been enclosed. The application fee for an after -the -fact tree permit is double the standard amount, as are mitigation rates. Please submit payment of $250.00 along with the completed application to the Building Department for processing. Mitigation credit may be given for the preservation of existing trees or the planting of new trees, so in addition to showing the size (diameter of trunk), location and species of trees that were 3741' Street / tree removal & permit requirements Page 2 of 2 April 6, 2010 removed, you should also demonstrate the size (diameter at breast height), location, and species of any trees to be preserved on the property as well as any trees to be planted on site.
