I am in receipt of the Tree Removal Permit Application submitted by you to the City of
Atlantic Beach. It appears that you have no ongoing construction or renovations that would
warrant review by the Tree Conservation Board. Further, the pictures supplied do indicate
that the tree is either dead or diseased/dying, thus posing hazard to you, your property,
and/or others. As a result, I am making a determination that you are exempt from the tree
removal permit requirement and the mitigation requirement, as described in Chapter 23,
Article 11 of the City of Atlantic Beach Code of Ordinances, for this particular double -trunk
Water Oak, found on the western side of the property located at 394 9th Street.
However, please keep in mind that Atlantic Beach does have minimum tree standards:
"One (1) four -inch caliper tree shall be planted and/or preserved for every twenty-five
hundred (2,500) square feet of lot area, or portion thereof, excluding there from preserve
areas and water bodies." [Section 23-17 (c) (2) (a)]
