We must remind you that permits must be obtained for any clearing and tree removal planned for this development site. Please note that according to the City of Atlantic Beach Land Development Regulations, Section 24-68 Land Clearing: "No Lands shall be cleared or grubbed, and no vegetation on any Development site disturbed, prior to issuance of all required approvals and Development Permits authorizing such clearing." Further, according to Section 24-168, Land Clearing, Tree Removal or Damage to Existing Trees and Vegetation: "The removal of damage of trees and vegetation shall be governed by Chapter 23, Article H. No lands shall be cleared or grubbed, and no vegetation on any Development site disturbed, prior to issuance of all required approvals and Development Permits authorizing such clearing." The first step in this process should be to conduct your tree survey and present those findings in form of a tree removal application to the Tree Conservation Board. Section 23-17 of the LDR explains the applicability of the tree protection ordinance, as well as provides the permitted process by which trees may be removed. Once determinations have been made as to protected trees and mitigation has been negotiated, you may move forward with your topographical and geotechnical testing.
